This is unbelievable and wrong!!! We have a 0.5% vacancy rate here. Yeah there is nothing to rent nor buy but I can see this happening here. Oh this makes my blood boil!!!!!!!

Wow - that is horrible. I hope you get it squared away with minimal impact to you.
When my friends had a house on a market their house showed up on a Craiglist ad for rentals (somehow they caught it). Sounds like it is pretty common. I feel horrible for property owners that have to go through the wringer to claim what is rightfully theirs.

If I own the property outright and have a for sale sign in the yard and have already moved into a new home, someone can just break into my house, toss possessions in, change the locks and put up a no trespassing sign and I can't get them arrested or at least removed from the property I own and didn't give them permission to move into?

Wasn't there a story not long ago about a person actually living in a person's house WITH them and they couldn't force them out? They were supposed to rent a bedroom but never paid. They were a horrible houseguest and there was nothing they could do for months and months.

The problem is particular in certain jurisdictions the police are very hesitant to physically remove people without a court order if there is any doubt whatsoever about their right to occupy the property. Someone produces a bogus lease - suddenly it's a civil matter and you must go through the eviction process; a person rents through airbnb for a length of time that grants tenancy (which can vary tremendously depending on jurisdiction) - now the owner needs to evict their tenant. Depending on the requirements to evict, that process can be time consuming and expensive - even if they are not paying any rent whatsoever.

the story I watched on Live PD was about a renter the landlord was trying to evict, and she even went so far as to change the locks and toss all the renter's stuff out into the yard. But the police told her, and the renter knew (which is why the renter called the police) that because she'd been living there past the cutoff-date (whatever it was; this was in Washington state, I think), that the landlord would have to take her to court and go through all the proper hoops in order to get her gone. The police told the landlord she had to let the lady back into the house in the meantime.

I'm very glad the police are involved. It boggles my mind that squatting isn't an immediate felony. The sad part is that there are children involved. We had some squatters on our street and it was a nightmare for the homeowner. In that case, she had rented to them, but didn't do a background check. They were horrible people, a family who just moved from home to home doing this. It was a nightmare to get them out. In your case, find out if you can go in immediately, change the locks and throw their stuff on the curb. Also, I would turn off all utilities immediately. Then again, you need to ask the police first. This stuff makes so mad for you.

Holy cow! Call a locksmith ASAP to come NOW and change locks back. Every minute and day is important, knock the door down if you have to. Today. I am inclined to think this is not a renter under false pretenses because of the No Tresspassing sign. My thoughts exactly. I find these occurrences disgusting. No one should be able to stay in a property that isn't theirs or that doesn't belong to the other party that signed a lease. How is a lease legal in such a case? And squatter's rights? They shouldn't exist. Ridiculous.

I feel for you. Who needs that crap to bring down their day? I hope you caught it in time because it sounds like they haven't actually moved in yet.
I have heard of this happening elsewhere. So sorry it happened to you. I'll be keeping my fingers crossed you can work it out without a big hassle.

My dad who was in commercial real estate for 30 odd years had never heard of this either. Evil people!!! Could be because the laws are different in Canada so it doesn't happen there? @missjen I hope it gets fixed quickly. The fact that bogus renters' rights would supersede the legal owners' rights is mind boggling. That needs to be changed.

I have a house that hit the market last week. My A/C tune-up guy was there yesterday and all was well. My brother got there today to check on it. Someone has taken down the realtor sign, broken in, changed the locks, hung "no trespassing" signs in the window, and begun moving things in. We think that what happened is that a scammer changed the locks, pretended to be the owner, and rented it to an unsuspecting victim. My brother and the realtor are there now, waiting for the police. Holy heck! I was just reading an article 2 days ago --- someone had the same thing happen. Someone broke into their house, changed the locks and put a For Rent notice on Craig's list - even had a lease and everything. Someone rented the house from who they thought were the owners of the house - only they were not!! Now they won't move out because they said they rented the house legitimately. (Apparently prepaid rent for 6 months and then prepaid another 6 months- they are in the 2nd half of the year living there). The courts says since they have a lease, they can't force them to move out, even though the owner was not the one they made the lease with. I feel for the family renting the house because how were they to know but still - it seems like if it is YOUR house, you could force people out if YOU didn't sign a lease with them. I hope you get whoever is in your house out of there....and it doesn't turn into a big mess. Wow!! I just can't believe people would actually do stuff like that. When I was looking into renting a house on the Outer Banks, NC, I had looked at some houses advertised on Craigslist. And I considered them. Then I decided to do a little research and I read that scammers do exactly what you suspect has happened in your case: they find a house that is legitimately listed (either for sale or rent) and copy the ad exactly and rent it to people. I think the article said they often use PayPal for the payment, rather than accepting a credit card. Often people don't know until they arrive for their vacation that the house they rented is not available. It's terrible, and apparently a common practice for these scam artists.
I hope you are able to resolve this easily. How terrible for you to have to deal with this!
