In my mid 20s I hit a girl who was about 18- while driving my parent's car,mthats I had borrowed, with my sister in and her toddlers in tow. Initially she was a pill yelling and cursing. The police came, she settled down and that night after concurring with her dad she asked if we would be willing to by pass insurance and just fix any possible damage between us. There was no body damage but she had slid in a ditch And she thought there might be undercarriage damage.
I would NEVER recommend doing this but I also didn't want my parent's insurance to rise so we agreed to have her take it to our mechanic who reported that there WAS some minor undercarriage issues that were older issues (rusted out parts) and not caused by the accident. We took a gamble on her morals (that she would not turn around and turn it in later) and DH asked him to fix them and bill us. Our mechanic, unbeknownst to us at the time, did inform her the damage was not caused by the accident and we were pretty stand up people for agreeing to fix it. She did not seem suprised or argue his point. He was pretty convinced she was taking advantage of the situation knowingly. She did come back to him some weeks later with another "issue" she wanted fixed and for him to bill us for it and he refused, telling her she was taking advantage. We waited and waited for her to turn the accident into the insurance but she never did. But the way we saw it, I DID hit her, so,some consequences were inevitable.

Let your insurance company deal with it.
My guess is she wants more than what your insurance (or hers) were offering to settle the claim.

I'm glad you weren't hurt.
However, I'm on the side of the victim. I have been rear ended three times. All I wanted were my bills paid, nothing more.
Each of those three times, the first person I talked to at the insurance company was nice, sympathetic, and assured me that of course they would cover all medical bills, car repairs, etc. Then each time they turned the case over to someone else who had the personality of an attack dog, and a determination to avoid paying anything at all. I had to eventually hire a lawyer after it became obvious that I would be stuck with all bills.
NONE of those times was I trying to get anything beyond my bills covered.
The only insurance company that treated someone in our family decently following a car accident was Progressive. Lawyers not needed.

I'm glad you're not hurt. And that insurance will handle this. I learned the hard way that you can't always tell at first how seriously you're hurt.

Ugh! I'm so very sorry that you have to deal with this. My dh was involved in a 4 or 5 car pile up in Chicago rush hour traffic, and he was the last car in it. Even though he didn't cause the accident he was the one that got sued by the first car. He also got the ticket because he was the last car. It seemed like it took forever to get resolved. He let the insurance handle it, and they all ended up in court, and the insurance company handled it.

My regular insurance won't cover a chiropractor. I'm surprised auto insurance will? Wouldn't occur to me.

Someone t-boned my mom years ago. My mom was crossing 4 lanes of stopped traffic and everyone let her go through, except the asshole who decided to drive on the shoulder to get around traffic. Regardless, my mom was found at fault. The jerk waited almost 2 years to the day to decide to sue my mom. He waited and waited and waited. Then went to an attorney at the last minute and stated what he wanted to do. The attorney did some digging and found out he had done business with my family in the past so he couldn't continue with the suit because of conflict of interest. Dumbass ran out of time to sue!
As for the attorney, that person is going to spend WAY MORE money on that attorney than the actual suit is worth. PIP covers stuff like that. I wouldn't worry about it. Your insurance company has their own lawyers.

I bypassed the orthopedic surgeon because I knew they wouldn't be able to really help me. I had soft tissue damage in my neck after being rear-ended. I was in the passenger seat and leaning over to pick something up off the floor when she hit us. I took the brunt of it. I had neck injuries in the past so I was more susceptible to injury. I went straight to the chiropractor and he treated me under PIP and insurance paid all of it and I got 2x my medical bills for pain and suffering.

Well I can hardly blame her for that if they're refusing to pay for her to see a chiro after being ear-ended. Insurance companies are notorious for trying to get out of stuff that they should be paying. Now she's had to get an attorney, which is really annoying on her end. I've been in her shoes, had an insurance company try to refuse payment for my medical bills when I was the passenger. I had to threaten legal action. But I'm sorry you're having to deal with this. It sucks! And I'm glad you weren't hurt! So, the person OP hit is trying to get OP's insurance to pay the chiropractor directly? That's not how it works. She's supposed to be going through her own insurance - they pay all medical/PT claims and repair costs then go after OP's insurance company in one go but the person hit doesn't wait because her own insurance kicks in immediately. At least that's the way it works in Oregon. I was rear ended last year and my van was totaled. When I got hit it ran me into the van ahead of me. The car that hit me then hit another car as he spun off mine. I called my insurance immediately and they worked me. It finally came down to the choice of working with the at fault insurance or paying the deductible to have my insurance pay. The driver had low coverage and there were 4 cars involved so there was a chance I wouldn't get much. His insurance was also notoriously slow. My insurance told me if I went through them and paid the deductible then any money they got from the first insurance would first go to reimbursing me. So basically I had a choice of getting things resolved for the most part quickly, but pay the deductible that may never be reimbursed or work through his insurance and take a chance on it not taking too long.

Bottom line is insurance companies do not want to pay $$$. It's a business.
I worked many years for an insurance defense law firm and we defended insureds of several different insurance companies. There is one that was the worst about paying and almost always went to court in hopes that the attorney would win and they wouldn't have to pay out much. Unfortuntely, that drags the insured through depositions and possibly trail.

People and insurance is a funny thing.
In March I hit bumpers with another car in a parking lot. I was in the middle of the aisle getting ready to park, he was pulling out of the spot. Where I was, I was "behind" a big car and he probably didn't see me. My car was hit on the corner of the car, his in the middle of the bumper. Minor damage to both cars. He made the off hand comment that he definitely wanted to get his car fixed.
We exchanged information. I called my insurance immediately, gave my information. I had just bought my car in December, so for sure was going to get it repaired. When I gave my statement as to what happened my insurance said it sounded like we were both at fault but they would need to talk to him. Which they did the next day. My rep confirmed that it looked like both at fault because we both admitted that we hadn't seen the other, and the damage seemed to prove that out.
That meant that each insurance would have paid half of the damage on both sides. I got my car fixed - it was around $800, paid my deductible went on with life.
I then found out that he never even called his insurance. I got a call from his insurance because they wanted my side of the story. His story had changed and he told them he was in the middle of the aisle. When I gave my statement to them (same story I gave my insurance) his guy said it sounded like my fault based on their clients story. I asked how it was possible for that to be true based on the fact that my damage was on the rear driver corner and his was in the middle of the bumper? He didn't answer.
My insurance told me not to worry about it, they would take it to arbitration if necessary, which would likely go 50/50.
I got a letter a month or so ago stating that they couldn't come to agreement so they were going to arbitration. Honestly, I'm just glad they are handling it. Either way, my car is fixed. If my insurance wins at arbitration, I'll get half my deductible back.
I still can't figure out why the guy never called his insurance though and got his car fixed. The whole thing is very odd.
