I have a question. I am new to Pinterest and found a cartoon image I would be interested in using on a Christmas card for the swap here.
The image is copyrighted and I have tried to research the artist and buy cards from her, to no avail. If I keep the copyright symbol and attribution to the artist on the cards for personal use here, am I in violation?
Thank you for your advice.

I follow a lot of meme people on instagram and I've noticed that often they will copy each other and that would drive me crazy because I'm following each for individual content, not to see the same meme 3 times in one day. So I used to tag the original poster, but then I figured she probably doesn't care and they are all ok with it.

But truthfully, you'd be using it for personal use only (making your own Christmas cards), you wouldn't be selling the image or distributing it free for other people to use, so I wouldn't really worry about it.

I did once. I follow a small artist on a FB who designs a line of products featuring cartoon cats. She's small, she and her husband run the business out of their home. She had previously shared that people were reporting finding enamel pins with her cats at the Francesca line of stores, so infringement was on her radar. I bought a pair of pajamas from JC Penney online, and when they arrived I realized the cat print was a dead ringer for her cats. So I privately messaged the artist to tell her my suspicions and share a photo. She thanked me and said she'd share it with her attorney. Because she's a "little guy" and just trying to earn a living, I wanted to help her out. I think it never hurts to let a person know and then they can pursue it if/how they want. I haven't reported copyright infringement, but was part of a large FB group where one girl kept posting other people's pictures as her own. I often could find the original photographer and would shoot them a note to let them know. The girl wasn't making money off it, but it irked me. All the photos were eventually removed.

So have you been personally affected in the past? Why do you think she would have had to have been personally affected to care about this issue? I guess I just suspected it because I felt there was a particular tone to the post That's not that people can't see the rights and wrongs or feel strongly about it without having personal experience.

My father was a well known photographer in a very specialized area. I know of 2 people who sell his work as their own. Pisses the hell out of me but since my mother and brother never wanted to confront them. Nothing I can do about it. That being said, I have no problem with people who use paper or fabric to make something else to sell. Just don't sell the original as your own.

When I was very active in online Cross Stitch communities we couldn't even post pictures of our finished Disney projects. Disney was very diligent on protecting their images. Also don't ever offer to make a copy of a hard to find pattern for someone cause folks would freak out. Me I am too lazy to worry about it.

This would make me extremely angry. Have you thought about doing something yourself about it? You don't have to confront these people yourself. Those photographs were copyrighted the second your father clicked the shutter even though he might not have gone through the process of filing them with the copyright office. It doesn't matter-they are still copyrighted under his name legally. I believe he holds the copyright for a number of years after his death. You might even be able to do this without an attorney by checking with the copyright office. Being a former professional photographer this matters a great deal to me, and all copyright matters do. I haven't seen any copyright infringement myself but if I do I would report it. I did see some just the other day on Pinterest when I came across stamp images I recognized from PSX stamps. Not sure what to do about that since the company no longer exists and lots of things on Pinterest have been copied from various places.

Just wanted to add that in my eyes copyright infringement is very important of any kind. Be it music, art, writing, or photos. What the person stealing it is doing is denying the artist their income of what they spent years going to school to learn, years learning to master and then worked very hard to create. Picture yourself having your paycheck stolen for a given amount of time. That is what it is like for the artist.
So yes, I would report it to the person who created the art if I saw it being copied somewhere else. Let that person figure out how to deal with it, or if it was a legitimate copyright infringement. It doesn't take very long to do that and it's the right thing to do.

Nope, couldn't be bothered wasting my time with that sort of thing. Big companies pay people to monitor things like that...I'm not going to do their work for free.
On a small scale if I knew someone and saw a product or art they created being copied by a bigger company, then yes, I'd definitely alert them to it...but someone I don't know or a big company...then no, I've got more than enough to do with my time already, not going to take that on as well.
