If you weren't at fault, then you should file with the at fault party. If you weren't at fault and would rather your insurance company handle it and then go after the at fault party, you will have to pay your deductible. If they subrogate, then you should get your deductible back.
I would not sit on this too long. If there were 4 cars involved, if the at fault party carries minimum limits, those limits can be met fast.

I work in insurance in MO for a large company. Insurance laws do vary by state.
I tell my customers that they have 2 choices in a case like this. They can file the claim with the company of the driver who caused the accident, and hopefully that driver has insurance in place. (Way too many uninsured drivers out there) Their liability coverage will take care of your car repair and medical expenses. You should have no out of pocket expenses in this case. It’s always worth a phone call to their company. It is ok to talk to the other company!
The second choice is to file with your company, initially pay your deductible {in my state we have to have a financial interest to represent you in a claim against another company), get your car repaired/replaced and your company will subrogate against the other company to recoup your deductible and any monies that your company paid out on your behalf. This can take several months.

Just remember—-everything you say xan and will be used AGAINST you. Even if you weren’t at fault.
Insurance companies goal will to be paying out the least amount possible.
You think your insurance is on your side, but they have shareholders to answer to.
Insurance companies are not your friends.

Call the person who hit you insurance company. But be fully aware that your insurance company will most likely receive a claim for the person you hit. Even though I was at a complete stop at a red light when I was hit? Unfortunately, yes, I believe this is the case. I was taught to stop behind a vehicle where I could see their tires meeting the ground in order to hopefully avoid hitting THEM if someone was to hit me from behind. Not saying this is your fault at ALL, and I'm so sorry you're in pain and having to deal with this absolute mess. But yeah, I think the driver in front of you is going to have to file a claim with your insurance company to get their damage covered. It stinks.

BTDT. Go through to insurance of the person who hit you. If you can't get action, then go through your insurance.

You should never speak to anyone else's insurance company. Your insurance company should handle everything. EVERYTHING.
You will have to pay your deductible, but you may be reimbursed eventually by the driver who hit you's insurance.

I hope there was just some confusion and the agent meant that you would have to pay the deductible UP FRONT but then be reimbursed for it later when they recovered from the other driver.

Thank you guys so much for the responses. I’ll read through the ones from this morning when I get home.
Feeling sore this morning... surprise surprise... spent an hour on phone with my insurance and ultimately decided to open the claim with them. She did say that there was a chance I will be reimbursed for my deductible. I don’t want added stress of dealing with his insurance and the fact I was pushed into a third vehicle that was pushed into a fourth, was the other reason.
I did laugh/roll my eyes when she asked if the headlight was damaged... that’s the least of the worries (but no). She said it is looking like a total loss (again surprise surprise).
On my way to clean it out before the insurance claims in and then to get a rental car.

File a claim with your insurance. They should waive the deductible when it is determined you aren't at fault & the other party has accepted liability.
I prefer to go through my reputable repair shop/get my rental car & much easier with my insurance.

I work for an insurance company in Illinois. If the other person is at fault it is best to turn it into their insurance company. Some people prefer to deal with their own insurance company and turn in the claim with their insurance company even if they are not at fault. In Illinois if your insurance company takes care of a claim where you are not found at fault the insurance company will subrogate to get their money back as well as your deductible. Once they receive the funds back for your deductible they will refund you that money. Keep in mind subrogation can take some time. Also, just because the other person may try to file a claim with your insurance company does not mean your insurance company will pay out.
