Looking at the patent information and the suits that have been brought, I am surprised they were granted the patents to begin with. I’d love to hear what our resident IP/copyright attorney thinks of them.

Looking at the patent information and the suits that have been brought, I am surprised they were granted the patents to begin with. I’d love to hear what our resident IP/copyright attorney thinks of them. I’m so darn curious about these suits. I just figure I must know zippo about patents and patents must not be for what I thought they were for. I can’t figure out the msp Stamp platform patent either. And even less understand her pending patent on a ruler that is essentially a quilting ruler that has existed my whole life but hers has more markings in both directions. I mean to me, granting a patent on her ruler is equivalent to someone patenting chicken soup because they added more veggies. But what do I know about law.

I just posted this on the lawsuit thread on the cardmaking board, but thought I'd post it here too, as it's relevant to the discussion: Jennifer McGuire just posted a link to this statement from Hero Arts in her Instagram stories and said she stands with them. Here's the text of the post: "You may have heard that Ellison, the parent company of Sizzix, has made claims of patent infringement against a number of companies in our industry, including Hero Arts. Just so you know, there is absolutely no reason to change any purchasing patterns with Hero Arts, as Hero Arts does not infringe, believes the lawsuit is without merit, and intends to fight this lawsuit and win for the good of Hero Arts and the industry. Whether we like it or not, the legal process is a method to resolve disputes, and we must let that play out. There is no reason to allow a chill on creativity or a disruption to business to creep into our beloved industry despite the current situation. In fact, let's work to do just the opposite and rally together to make our community even stronger. Hero Arts and the other companies involved remain the same creative, reliable, top selling brands you trust and love. If you have any questions, do not hesitate to ask us at info@heroarts.com or leave a comment." What a hypocrite she is!!!! It was fine to "allow a chill on creativity" when her bitter pal Petunia sued the crap out of everybody after having been granted a bs patent on printing press technology that's been in use since the 17th century. But now, NOW, she's standing behind HA as they protest these bogus patents. I think the Sizzix patent is w/o merit too, Jennifer! But I think the My Bitter Petunia patent is also so much garbage.

Oh, even better, there's a comment on Hero Arts' blog post supporting them in fighting sizzix from Ileana Rivera. Isn't that the Misti woman? Talk about a double standard.

No that's not her. It's Iliana but I know her last name isn't Rivera.
eta: it's Iliana Myska or something like that.

No that's not her. It's Iliana but I know her last name isn't Rivera. eta: it's Iliana Myska or something like that. That's correct. From MSP's about us page: "Iliana Myska has been paper crafting since 2001. She initially started card-making when she was asked to serve on the Women’s Ministry. By agreeing to be in charge of the Card Ministry, Iliana began a new journey. Using her scrap booking supplies to embellish premade card bases, her addiction to crafting grew into stamping. While making one hundred Christmas cards for Bethany Baptist Church, Iliana became frustrated with errors and inconsistencies while stamping. After her failed attempt to Washi tape a stamp press to a mouse pad, an idea occurred. Several trips to the hardware store and MISTI was born."

I'm surprised she didn't patent using scrapbook supplies to make cards.

This lawsuit reminds me of the Spellbinders/Quickutz lawsuit a few years ago. I still miss the monthly release of Quicktuz dies! Gosh me too! And my lss quickutz die club. 😔😞

This lawsuit reminds me of the Spellbinders/Quickutz lawsuit a few years ago. Well, there is a connection. If Spellbinders had not lost their patent for the thin dies in that lawsuit, Sizzix would probably not have been able to just move the cutting edge to the center and file for a patent.
