So if they vote to impeach him today and the Senate votes to remove him, is it immediate? And therefore Pence would become President. Do you think there’s a chance he would refuse to take the oath?
Never mind: I hadn’t see that McConnell won’t reconvene til next week anyway.

I just saw somewhere that McConnell is refusing to reconvene the Senate and it will force the senate "trial" to after Biden is in power. Which is a dick move. I hate McC.

No, I don’t believe Pence would refuse, if that situation occurred. ETA among other reasons, because if he refused to step into the office, the next in line is Nancy Pelosi.

Trump won’t be removed before the 20th.
It would be virtually impossible.
The trial in the Senate won’t be held until after the 20th.
Hypothetically, if Trump were removed (and let me be clear - I believe there is zero chance of that), Pence would not refuse to be sworn in because then Pelosi would be sworn in.

I "think" if Pence were to NOT take the oath, it would fall to Pelosi--Not sure though.

After the House votes today, it still has to go to the Senate for a vote. And the Senate is not scheduled to reconvene until the 19th.

I realize Pelosi would be next and her name is poison to the GOP but I also wondered if there’d be an attitude of “well the dems are taking over anyway” and a belief that not taking the oath would give him some self preservation among the base.

I think they would literally kill him with their bare hands if he willingly allowed Nancy Pelosi to become president, even if only for a few days.

Even if by some miracle Mitch recalled the Senate and started the trial today, the reality is it wouldn’t be finished before the 20th.

Everything I saw said they would move to vote this afternoon. The House will vote on impeachment today. Then it has to go to the Senate for a trial in order to remove the president. So part one will likely happen today; part two won’t happen until after the inauguration, as the Senate is still under McConnell’s control until then.

From a procedural stand point, the Senate cannot start with anything until after the House is finished. The House has to vote on the articles of impeachment, then they are delivered to the senate, then there is a trial. They can’t both happen at the same time. It’s like a criminal proceeding - the impeachment is the indictment/charges. You can’t start a trial until the charges are finalized. And then the process in the Senate is a trial. There will be lawyers, evidence, witnesses. It will take a huge amount of time.

I think it would only be self preservation for the extreme Trump nutters if he refused. There would probably be a lot more that would be mad that he let Pelosi be President even if only for a few days.

I didn’t say it was a requirement, I’m talking about the reality of what’s going to happen with this impeachment. The reality is he’s going to be impeached, he’s not going to be removed from office before the 20th, and the trial is likely to be a long fiasco. I thought I heard Mitch decided he’s in favor this time. Of course, knowing Mitch as we do, there’s probably some Machiavellian scheme up his sleeve.
