Two New York state men who led a mob that overwhelmed police at the perimeter of the Capitol on Jan. 6, 2021 — then bodysurfed over the top of the crowd at a building entrance and pepper-sprayed officers — were both sentenced Friday to 44 months in prison," The New York Times reported. "Cody Mattice, 29, of Greece, N.Y., and James Mault, 30, of Brockport, N.Y., both wept as they stood before Chief U.S. District Judge Beryl A. Howell and asked for leniency, apologizing for their actions and saying they hoped to return soon to their families and young children. But Howell noted that prosecutors had already cut them a reasonable deal by dropping charges that could have led to far more prison time, and she imposed the sentences requested by the government. Following his prison term, he will be placed on three years of supervised release. He also must pay $2,000 in restitution. The DOJ stated that “Ponder ran out from the crowd and swung a long, thin pole at a U.S. Capitol Police officer. The officer protected himself by raising his riot shield above his head. Ponder’s pole struck the riot shield and broke in two, with part of the pole flying off to the side.” After retreating into the crowd, the report said, “Ponder re-armed himself with a new, thicker pole that was colored with red, white, and blue stripes. He swung (it) and banged it against the ground in a menacing manner. He was one of those who was able to get a handgun into the Capitol on Jan. 6, 2021 and was caught in a video talking about wanting to kidnap House Speaker Nancy Pelosi and drag her down the stairs so her head hit every step.... IIRC, he's also the one who threatened to kill his own kids if they turned him in. His son called the FBI.

Thomas Robertson entered the Capitol with the first breach of rioters that day, prosecutors said, and marks the second rioter convicted by a jury to be sentenced. Guy Reffitt, the first riot defendant convicted by a jury, received the same sentence of 87 months behind bars -- the highest sentence in a January 6 case to date. Washington, DC District Court Judge Christopher Cooper said Robertson's actions after the riot were the most "striking and concerning" part of the case before handing down his sentence. "You think partisan politics is war. You continue to believe conspiracy theories," Cooper said to Robertson, adding: "I sincerely believe you would respond to a call of duty if called to do something like this again. Robertson, a former sergeant of the Rocky Mount police in Virginia, wrote in a March 2021 text to a friend, "I can kill every agent that they send," assuring they would never see him "surrender to be a political prisoner." Robertson is one of more than a dozen January 6 defendants so far to opt to take their case to trial instead of entering a plea agreement. Robertson's substantial sentence -- along with the sentence given to Reffitt -- could encourage January 6 defendants with sights on a trial to instead accept Justice Department plea deals. Only one accused rioter who went to trial was acquitted on all charges. Cooper noted that Robertson, who was dressed in an orange prison jumpsuit, chose to go to trial and did not accept responsibility for his actions. "That's your choice," Cooper said. "But this is the consequence of that choice." During his trial, prosecutors detailed what they considered Robertson's preparation for the attack. They presented a post he allegedly wrote a month before January 6, 2021, calling for an "open and armed rebellion" and told the jury he brought three gas masks and food rations to DC. Robertson's co-defendant and former subordinate at work, Jacob Fracker, pleaded guilty to conspiracy in March and testified for hours against Robertson, a man he said he used to affectionately call "dad." The jury also heard testimony from DC Metropolitan Police Officer Noah Duckett, who said a man prosecutors identified as Robertson struck him and another officer with a stick. Katherine Schwab of Texas, who said she accepted an offer to fly on the personal aircraft of a Facebook friend, admitted to writing in messages before the Capitol attack that 's--t will go down' and that she needed to 'stop the steal,'" said the report. "Schwab traveled to Washington, D.C., with codefendants Jenna Ryan and Jason Lee Hyland, and admitted she was the first of the trio to enter the Capitol on Jan. 6." The charge Schwab will accept is disorderly conduct in a restricted building. "Schwab admitted to kicking and throwing media equipment with other members of the mob outside the Capitol," said the report. "'I went into the f---ing Capitol,' Schwab admitted saying in a video recording on the day of the riot, calling police 'traitors,' 'sheep' and 'pathetic.' 'You want a revolution, the revolution’s gonna come... you want a f---ing revolution, it’ll happen,' Schwab also admitted saying." According to a filing by federal officials, "Before leaving the Capitol grounds, Hyland, Schwab, and Ryan arrived at a press enclosure where members of the crowd were attacking media equipment. Schwab joined the assault, kicking media equipment and throwing one piece of equipment on the ground while Hyland and Ryan observed." Schwab's coconspirator Ryan became infamous for openly boasting that "I have blonde hair white skin a great job a great future and I’m not going to jail." When she was sentenced to 60 days in jail, she claimed that she was being treated like the Jews in Nazi Germany. She has subsequently served her sentence and been released. Nearly 900 people have now been charged in connection with the January 6 attack on the Capitol.
