5th circuit decision on MIFEPRISTONE. Rolls back access to drug. Drug will stay on market for now. Medical personnel, doctors presented enough evidence to think it is safe but needs more investigation.. Doesn’t surprise me. The 5th Circuit is one of the most conservative courts. This isn’t really about the drug and its safety per se like the plaintiffs claim. That’s just a pretext. What this is really about is them wanting to completely cut off access to abortion. Now to the Supreme Court. I hope they’re a little bit more leery now of siding completely with the anti-abortion crowd. I'm sure they’ve seen how even in red states, voters are saying no to ballot measures that are anti-abortion. I’m guessing the SC may not take the draconian measure of removing Mifepristone off the market altogether, but they’ll maybe tinker around the edges and see which expanded access they can get rid of.

I don’t understand how the doctors in the case have legal standing. Because they might have to treat a patient in the emergency room after they take the pill? In states where abortion is illegal? And somehow judges are more qualified than the FDA to make decisions regarding the safety of a drug? All 3 judges have a history of anti-abortion decisions. Yes, isn’t that something?! That’s why we know they lie—it’s not about the safety of the drug and the risks to women. The drug has been around for 23 years. It’s riskier and much more painful not to do the combo. The TX judge wanted to completely invalidate the drug and take it off the market. Okay, that didn’t fly. 5th said they won’t invalidate but they’ll remove the expanded access FDA implemented. Why? There’s no logic. Whether women get the prescription from the doctor or the pharmacist, or whether they get it in person or via mail, what do those things have to do with the safety of the drug? Further, why put a restriction on women taking this only up to seven weeks? If doctors say it’s safe up to ten weeks, do people in black robes know better than the doctors? Ten weeks is well within the first trimester, so what’s the problem? The Supreme Court said it’s up to states to decide abortion. Well, then, why are these judges making decisions that will restrict access to the drug for women in all states?
