Am I remembering correctly, you're in Minnesota? I believe Minnesota is a no-fault state - so medical expenses and lost wages will hit your insurance first and then if they exceed your limits, the at fault driver's liability coverage will kick in. With those types of injuries, I'd speak to a lawyer to at least understand process and options. States differ quite a bit on car insurance laws so keep that in mind when getting advice from people in other states.

I'm very sorry this happened to you. I hope you both heal quickly without any long-lasting effects.
The key to how this turns out will be what kind of insurance the driver at fault has. DH was in an accident that wasn't his fault 2 years ago and the other drivers cut rate insurance basically decided not to pay. They made up an excuse that DH was partially at fault even though the other driver got the ticket. Our insurance paid as an underinsured motorist. There weren't as many expenses as in this case it doesn't sound like. I don't know the laws in Minnesota but in NC, the driver who hits you from behind is at fault regardless of the circumstances so his insurance shouldn't be able to weasel out.
I hope the other driver has sufficient coverage and you get the settlement you deserve.

We decided to get a lawyer. I'm glad you are. That was going to be my advice too. And I hope you and your husband are able to heal soon without too much residual effect from this. Such an awful thing to have happen!

I wonder how that works. I know MN is no fault, BUT I also know if you rear-end someone you are deemed at fault/responsible. Isnt that an oxymoron?

I'm really sorry, that is scary! My best friend's mother and aunt were killed in an identical type accident years ago. The ladies were in the back seat and the men were in the front. The men were hurt but survived. I'd recommend a lawyer, to be honest.

Thanks for asking! we are still pretty banged up, very sore and stiff. I went back to work on tues. My dh is still off, but hopes to go back next wk. He can't drive, so will have our neighbor drive him. He gets the staples out of his head today. We did see a lawyer, and he took our case, and is moving it forward. We both have insurance, so it will be the insurance Co's going back and forth on what they are willing to pay. We just hope to have all our medical bills paid, lost of wages. Our insurance co. already paid us for my car, which was a good settlement, so we took it. It of course is not the price of a brand new car, but it was what the car was worth at the time. So we need to find me a car yet. We hope to have all the other bills paid by our insurance co's, and settled hopefully in 6 months. It's not a quick process, and the guy that hit us had the equivalent amt of insurance as us, so that's good!!
