MAGA flags were on 2 Alito properties now

Ah, ha!! Mrs Alito seems to have a short fuse with venom toward her neighbors!! Her DH was with her during the following incident. She was not alone when she was approached!


On Saturday morning the Washington Post reported that a story on an upside-down American flag seen flying in front of Justice Samuel Alito's home was shelved by the paper in 2021 because it was not believed the justice had anything to do with it.

Saturday's report does shed new light on Alito's wife, Martha-Ann, flipping out on the Post's Robert Barnes who has since retired but did recall the encounter with her as fairly unpleasant with her snapping at him to "get off my property" as he approached the couple coming out of their house.

According to the report from the Post's Justin Jouvenal and Ann E. Marimow, on Jan. 20, 2021, "Barnes went to their home to follow up on the tip about the flag. He encountered the couple coming out of the house. Martha-Ann Alito was visibly upset by his presence, demanding that he 'get off my property." As he described the information he was seeking, she yelled, "It’s an international signal of distress!'"

The Post is now reporting, "Martha-Ann Alito then got out of the car and shouted in apparent reference to the neighbors: 'Ask them what they did!' She said yard signs about the couple had been placed in the neighborhood. After getting back in the car, she exited again and then brought out from their residence a novelty flag, the type that would typically decorate a garden. She hoisted it up the flagpole. 'There! Is that better?' she yelled."

U.S. Supreme Court Justice Samuel Alito's defense for why an upside down American flag, associated with the January 6, 2021 insurrection and the "Stop the Steal" conspiracy, was flying outside his Virginia home quickly fell apart barely days after he shared it with Fox News, but that story has now further disintegrated after The New York Times published a report that includes interviews with neighbors and a review of text messages.

Critics responding to The Times' report are now calling the 74-year old jurist's credibility into question over the divergent details.

Noting there are "some differences" between the Alitos' story and the Badens's, The Times importantly reports, "the justice told Fox News that his wife hoisted the flag in response to Ms. Baden’s vulgar insult. A text message and the police call — corroborated by Fairfax County authorities — indicate, however, that the name-calling took place on Feb. 15, weeks after the inverted flag was taken down."

Alito's recusal refusal was met with more scorn the surprise on Wednesday, a brief scan of social media shows.

"Well, we'll just have to legally remove Alito from the court, won't we?" replied political commentator Keith Olbermann.

"Alito does a Reverse Uno, suggesting that people calling for his recusal are trying to influence the outcome of cases before the Court," responded former FBI special agent Asha Rangappa. "He really is a piece of work."

"Alito does not care a wit for decency, the integrity of the court, or the good of the Republic," wrote X user Brian Wasik. "He's a partisan troll."

Alito’s Aggrieved Letter to Congress Tips His Hand in the Jan. 6 Cases

.........His statement, filed on Supreme Court letterhead and overflowing with Alito’s trademark aggrievement,[/b] is best interpreted as either an unreconstructed piece of lawless trolling or a meditation on the nature of female autonomy. It will at least clear up one thing: The justice has not been chastened by recent events and will carry forward his nihilistic attitude into the explosive final weeks of this term.

But there’s more. So very, very much more. Enough to merit a stamp of approval from Donald Trump himself. The justice’s wife “possesses the same First Amendment rights as every other American.” Plus, she is an “independently minded” person who “makes her own decisions,” Alito writes, “and I have always respected her right to do so.” He hits that point again later, elaborating that Martha-Ann “makes her own decisions, and I honor her right to do so.”

You might even say his principal defense is that she has … a right to privacy! Recall that when Alito served on the U.S. Court of Appeals for the 3rd Circuit, he voted to gut Roe v. Wade by upholding a law that would have let husbands veto their wives’ choice to have an abortion.* Justice Sandra Day O’Connor found his opinion so repulsive that it pushed her to embrace a right to abortion, preserving the core of Roe in 1992, and to note that Alito’s position would have given abusive husbands even more control over their wives.

Later, of course, Alito got his revenge on women, from O’Connor on down, when he authored Dobbs in 2022, overruling Roe v. Wade and giving abusers another potent way to terrorize and abuse their pregnant partners. Yet now he has granted his own wife the autonomy he has spent his career stripping from American women. He has emphatically granted her a right to privacy, rooted in a freedom to make individual choices, that he has denied to the rest of the country. Women unfortunate enough to lack powerful husbands don’t get to play the privacy card when they feel that their rights and dignity are under attack. Alito is comfortable, even gleeful, when eroding the rights of every other woman in the country, yet deeply uneasy about encroaching on those of his own cherished bride.

Under Alito’s analysis, #feminism requires that his wife be allowed to fly a deeply political flag in the midst of a deeply political season in which the court itself is deeply entrenched—even a Trump 2020 flag or “Stop the Steal” flag, since her property and free speech rights have no limits. Perhaps most essentially, it is important to understand that Martha-Ann Alito has Feelings. She feels hurt and outrage and persecution and sorrow, “having to endure numerous, loud, obscene, and personally insulting protests in front of our home that continue to this day and now threaten to escalate.” The Alitos’ disgust and contempt at facing public protests oozes off the page. (The First Amendment, too, is apparently another right that only Martha-Ann Alito gets to claim.)

Of course, there’s the obligatory feint at originalism: The “Appeal to Heaven” flag is about “the American revolution,” Alito writes, and it expresses merely “a religious and patriotic message.” As is inevitably the sole defense he can muster, “the use of an old historic flag by a new group does not necessarily drain the flag of all other meanings.” No one should be surprised that the author of Dobbs—a decision that cherry-picked and butchered history to reach a preferred outcome—would ignore the intimate ties between this flag and fringe right extremists. For Alito and his fellow GOP appointees, originalism means slicing and dicing history to fit whatever reality you favor. The flagrant violation of the flag code? The winking support for “Stop the Steal”? It means exactly what the justice wants it to, and nothing more. Your offense is the real offense.

The crazed Jan. 6 protesters who marauded through the Capitol to stop the transfer of power to Biden? Their attitude has more than a little in common with Alito’s. Do whatever you want, break whatever you want, say whatever you want. And the man currently deciding whether they can do so free of legal consequences has, time after time after time, announced that he too is unconstrained by legal consequences. Being so politically angry you’re basically out of control? That is enough.

Judges are asked to recuse themselves when their impartiality can reasonably be questioned because we don’t think it’s appropriate for judges to have prejudged a matter before them and told us their views in advance. On top of someone throwing a spouse under the bus and calling it feminism, this letter prefigures perfectly Alito’s views of both the president’s immunity claims and the defenses of the rioters in Fischer: Insurrections are just lawful protest; incitement of violence is just First Amendment–protected speech; if you ignore context and politics and facts, the accused are always innocent and those seeking accountability are always vicious. After Wednesday, we don’t need to wait for the Alito opinion in Trump or Fischer. We’ve already seen it.

According to Alito's letter, no "reasonable person" who saw those two flags flying at his two homes would associate them, and the Alitos, with the insurrection, or Christian dominionism, and thus here is no need for his recusal.

In his 2022 opinion, a "passerby" would conclude the owner of the flagpole was conveying a message, but the flagpole owner could "disavow" those messages.

As Geidner notes, "Alito believes you — and, perhaps, his colleagues — are stupid."

Justice Samuel Alito may have committed an impeachable offense in the course of defending from the upside down-flag controversy in which he's embroiled.

Former federal prosecutor Harry Litman appeared on CNN on Saturday, where he was asked about the recent scandals facing members of the nation's highest court.

The host brought up the fact that the neighbor at the heart of the alleged incident contradicted Alito's position and suggested he's "lying."

Litman then notes that "there is the discrepancy and I really think it is essential to get to the bottom of it.

"If it's the case, I am not saying it's the case, but if it is that Justice Alito sent a letter her to the congress and didn't tell the truth in it. That is exceptionally grave. I think that would be an impeachable offense."
