Some people think that suing is the equivalent of winning the lottery, thanks to shows like LA LAW. In fact, it's just not worth it if your friend's dh is suing for the payoff. Years ago, I had a big metal ladder fall on my head at work. I was hospitalized for 3 days and needed a lot of PT and medical appointments. The only reason I finally sued is that the workers comp company stopped paying for treatment. The case settled and the rest of my medical expenses were covered, but I didn't get any money. I didn't want money, but I wanted my medical covered, because it was a very expensive accident. My lawyer at the time explained that people don't make much in a settlement, but they always think they will.

The husband needs to keep in mind that if he sues, the insurance company can come to him to be reimbursed for all monies they paid out. After repaying the insurance company and a lawyer, he may not get anything. Yep. This was the case when my parents were killed. My dad was in the ICU with traumatic brain injury for 11 days and had two surgeries. We sued the guy who did it and his boat insurance paid, but dad's medical insurance took most of it. I can see suing in this case to recover the cost of medical treatment and lost wages, but would look askance at someone who tried to get punitive or pain and suffering damages for slipping on a green bean. I know the store is generally held liable in these cases, but I also think we as consumers have a responsibility to look where we're walking. Do you live in eastern wa?

I was rear ended over four years ago, am still being treated, and the case, which I had to bring because I was still being treated at the two year statute of limitations mark or NO bills would be paid, is settling for so little that the bills will not be covered, the lawyer will not get paid, and I may end up in medical bankruptcy. It's extremely difficult to prevail even when liability is obvious.

Don't get me wrong, I want for her medical bills to be taken care of either by her insurance or the grocery stores. Her husband is what bugs me. They are all lawyered up and getting ready for a fight. I think he wants the moon and more. I hope your friend gets all of her medical expenses covered and I hope her greedy husband gets nothing.
