I live in a community with about 70 homes in a circle that has an HOA fee ($450/year). We abut the common area which consists of sidewalk meandering though a main area and grass . Since March, there has been a group of folks that uses this space as a dog park (they posted it on the community bulletin board to attend). We have lived here for 17 years and the common space was not used as a dog park previously or ever. People walk their dogs on the path and have not used this as a "dog park." I am defining the dog park as about 2-5 dogs chasing something and aggressive barking for 30-60 minutes. I don't like dogs. I was bit by one when younger. These dogs have an aggressive bark sound... like a deep one.
One of the dog owner's dog came into my yard, sniffing in the trash, and I asked why his dog was in my area, and he said that since I didn't have a fence that it was my problem because my yard wasn't fenced. I said that I don't have pets that I don't need to fence my yard. Another scenario I suggested is that they should go to a dog park, but the dog owner said that they are closed when he gets off work and they pay their HOA fees so I can do this... There's no leash law in Arapahoe County.
I know I should contact the HOA... but am I out of line? I was on the HOA committee several years ago, so there's no rules on this. Many neighbors walk their dogs in this area (walk through and pick up the poo) but they don't have a dog park session.
I can understand stuff for Covid, but this is almost every night since March.

It’s humane and they likely won’t come near.

In Texas it is cities that usually have the power to make ordinances for leash laws and pet behaviors rather than HOAs. HOAs can designate a space for a specific use but city law trumps HOA bylaws for the most part.
I second the sprinklers. You can also try one of the noise makers that are silent to human ears but animals can hear.

Not okay that people are in your yard. Yes, they can walk on the sidewalk that goes through your yard, but they need to keep their pups on a leash. I'd contact the HOA and ask them what you should do.

Definitely contact the HOA. I used to be on the board when I lived in a place with an HOA and this is definitely something we would want to be aware of and make formal rules regarding.

I get it your annoyed and uncomfortable with the dogs but that comment is just cruel. Take it up with the HOA go through proper channels so there’s no questions. They obviously need to create some bylaws that cover this.

I would talk to the HOA but I would also try to keep the dogs from wanting to be on your property. I have heard that red pepper flakes help so I would buy it in bulk and sprinkle it everywhere.

I love dogs and enjoy seeing them being walked past my house. In my yard I'd turn into a tiger. If the HOA wants to have an off leash area they should fence it.

Your HOA doesn't have a requirement that all dogs are to be on leash?! I would definitely go to the HOA.

I live in a sub with a community park. All dogs have to be leashed at all time due to city laws and safety of others. Residents here wouldn’t just be allowed to designate a commons area as a dog park and unleash their dogs in an unfenced area. Contact your HOA.
