BY ELEANOR KLIBANOFF DEC. 8, 2023. UPDATED: 1 HOUR AGO “Texas Attorney General Ken Paxton has asked the state Supreme Court to intervene and stop a Dallas woman from having an abortion. Paxton’s office petitioned the high court just before midnight Thursday, after a Travis County district judge granted a temporary restraining order allowing Kate Cox, 31, to terminate her nonviable pregnancy. Paxton also sent a letter to three hospitals, threatening legal action if they allowed the abortion to be performed at their facility.This is the first time an actively pregnant adult woman has gone to court to get an abortion since before Roe v. Wade was decided in 1973. A similar case was filed in Kentucky on Friday. In the petition, Paxton asked the Texas Supreme Court to rule quickly, saying that “each hour [the temporary restraining order] remains in place is an hour that Plaintiffs believe themselves free to perform and procure an elective abortion.”Nothing can restore the unborn child’s life that will be lost as a result,” the filing said. “Post hoc enforcement is no substitute, so time is of the essence.”The Texas Supreme Court is currently also considering a similar case, Zurawski v. Texas, in which 20 women claim they were denied medically necessary abortions for their complicated pregnancies due to the state’s new laws. The state has argued those women do not have standing to sue because, unlike Cox, they are not currently seeking abortions. In the initial lawsuit, Cox’s attorneys with the Center for Reproductive Rights argued she cannot wait the weeks or months it might take the Texas Supreme Court to rule. Now, the high court must consider many of the same arguments as those in Zurawski v. Texas, but on a much tighter timeline. The central question is whether a lethal fetal anomaly qualifies a pregnant patient for an abortion under the narrow medical exception to the state’s near-total abortion ban. Cox’s lawyers argue that continuing this nonviable pregnancy poses a threat to her life and future fertility, thus necessitating an abortion. Travis County District Judge Maya Guerra Gamble agreed, saying it would be a “miscarriage of justice” to force Cox to continue the pregnancy. The state disagreed, telling the Supreme Court that Guerra Gamble’s ruling “opens the floodgates to pregnant mothers procuring an abortion” beyond the scope of the medical exception.Separately, Cox’s lawyer, Molly Duane, sent a letter to Guerra Gamble, asking her to bring Paxton in for a hearing on his letter threatening legal action against hospitals that allow Cox to have an abortion. “The repeated misrepresentations of the Court’s [order], coupled with explicit threats of criminal and civil enforcement and penalties, serve only to cow the hospitals from providing Ms. Cox with the healthcare that she desperately needs,” Duane wrote. “Plaintiffs respectfully request the Court hold a hearing so Defendant Paxton can explain to Your Honor why he should not be sanctioned.” Texas Congresswoman Veronica Escobar, on behalf of President Joe Biden’s re-election campaign, condemned Paxton’s comments Friday. “A Texas woman was just forced to beg for life-saving health care in court and now any doctor who provides her the care she urgently needs is being threatened with punishment including a lifetime prison sentence,” Escobar said in a statement. “This story is shocking, it’s horrifying, and it’s heartbreaking.”

I honestly just can't fathom the personality that says "here is a mother of two who very much wants to be a mother of three, and who is carrying a fetus that is threatening her health and will suffer and die shortly after birth if it makes it that far, and what I believe is that it is my solemn duty to ensure that all that suffering happens."
I don't believe in hell but hope people like that get a taste of it.

Not only will the baby die but she may not be able to have more children if she is forced to continue with the pregnancy. This has been covered the last two nights on the CBS evening news. These Right to Life people need to come up with a new name because they can't seriously think they are protecting anyone's rights at this point.

This is an abomination and any and everyone involved in forcing this woman to continue her pregnancy should be ashamed. For factual accuracy, the fetus has an abnormality that makes the pregnancy nonviable, but is not yet deceased. The complicated nature of pregnancy is why WOMEN should make the decision regarding their bodies and the government should not be involved.

I read that article earlier today. There was another linked story about a woman in TX who was forced to carry nonviable TWINS to term. Both babies passed away shortly after birth. I swear, I can’t understand how these ghouls keep getting elected when they are the direct cause of these people’s needless suffering and expense.

Non viable means it won't live after birth. It is not yet dead, but won't survive on its own after being born.

However, the question still remains - if the baby isn't viable, a life isn't being saved by denying the procedure, just harm inflicted upon the mother.

I don't understand the thinking on this sub human, Ken Paxton. He and the other GOP MALES in the legislature of Texas need to have all sorts of evil things in their lives so they can learn some compassion and respect.
I will never understand why anyone gets concerned over a HEALTH issue that is between a woman and her physician. All others need to walk away and butt out.

I feel for the mother. She's facing a really difficult, tragic situation. And having to ask permission through the courts, knowing that a medical decision that should be between her and her doctor will be decided by judges just adds to the trauma. Ken Paxton is trying to score political points at the expense of this family.

I think her health is such that she isn’t able to travel at this point. The article said that she had been admitted to the ER multiple times already just within the past weeks. It’s a total shitshow. If I lived in TX and was of childbearing age and actually wanted kids, there is no way in hell I would get pregnant there in the world of today. It’s devolved into a dystopian society. |

Deep down, Republicans believe that when a pregnancy goes wrong, it is somehow the woman’s fault and she deserves whatever suffering may come as a result. Women who vote for Republicans also lack empathy. Their first thought on reading a story like this is, that would never happen to me. I wouldn’t have a bad pregnancy outcome because I am a Good Person. We see this over and over again, like with the women who have sued the state over these laws. Several said they were conservative pro-life voters who never imagined they would need to end a pregnancy until they couldn’t. The more cynical among them, also lacking empathy, rationalize their vote with the sure knowledge that they can easily afford to visit another state for an abortion if needed for any reason. What does it matter to them if lower-income women suffer? This isn’t just happening in Texas, of course. It can and does happen in any state controlled by Republicans. From Florida:   Those who say women in these states should “just move” are also lacking empathy, though, and use that dismissive statement as a way to assure themselves that bad things happen to women in red states because those women somehow deserve it for living there. It’s the same misogyny from another side. Fact is that a woman’s right to bodily autonomy and to make the healthcare choices that are best for her should not be dependent on the state she lives in. Codifying abortion rights into federal law so that all women are protected needs to be a priority of every Democratic congressperson and senator. None of us is free until we all are. |

I would amend that to no one who has an actual choice and even then, I’m not sure that’s fair. People, women in particular, should not be punished because of where they live, circumstances that might be beyond their control. Women should not be denied medical care because of where they live |
