Interesting. My data was definitely breached. I had to get a new debit card. But I don't know that I suffered any "losses." My bank reimbursed me for the lost money. But it was a PITA. Can I get punitive damages?

Can I get punitive damages? I think that would be doubtful. Imagine if all of us who had our data compromised filed suit for punitive damages. The courts cannot possibly work all of us enough money to make it worth while. And really, all that happened to me was the bank told me they were sending me a new card. I had to change a couple of my auto pays. So I can't see that that's worth any serious money. And where they actually negligent?

My info was breached and I had to get a new card. Sure it was a hassle, especially at that time of the year but in the big scheme of things it could have been far worse. I have nothing I could file a claim to collect on and for that I am grateful.

Here is the rest of the email: If You Shopped at Target from November 27 through December 18, 2013 or Received Notice That Your Personal Information Was Compromised, You Could Get Money for Losses from a Data Breach Settlement. A Settlement has been proposed in lawsuits against Target Corporation (“Target”) relating to Target customers whose credit/debit card information or personal information was stolen as a result of a data breach that was first disclosed on December 19, 2013 (“Target Data Breach”). Target’s records show you are included in this Settlement and may be eligible for a cash payment. Visit www.TargetBreachSettlement.com for more information or to file a claim. Who is included in the Settlement? You are a member of the Class if: (1) you shopped at a Target store and used your credit or debit card from November 27-December 18, 2013; (2) you provided your contact information to Target before December 18, 2013; or (3) your bank, credit card company, or other financial institution issued you a new credit or debit card shortly after December 2013 and informed you that your old card may have been compromised. If you received a notice directly about the Target Data Breach, you are a Class Member. What does the Settlement provide? The $10 million Settlement Fund will provide payments to consumers who have had losses caused by the Target Data Breach. If you are included, you can choose between two types of payments: • If you have documentation, you can receive reimbursement of losses up to $10,000. These losses include unauthorized, unreimbursed charges; certain costs and fees; and lost or restricted access to funds among other things. • If you do not have documentation, you may be eligible for an equal share of the Settlement Fund remaining after payment of claims for documented losses and service payments. For example, if the total of service payments awarded by the Court plus documented claims adds up to $1 million and 300,000 Settlement Class Members submit valid claims without documentation, you will receive $30 from the Settlement Fund. The amount of actual payments will depend on the amount of claims received. How can I get a Payment? Submit a Claim Form online or by mail by July 31, 2015. The payment amount you receive will be based on the amount of losses you can document and/or the amount of claims filed. What are my rights? Even if you do nothing, you will be bound by the Court’s decisions. If you want to keep your right to sue Target yourself, you must exclude yourself from the Settlement by July 31, 2015. If you stay in the Settlement, you may object to it by July 31, 2015. The Court will hold a hearing on November 10, 2015 to consider whether to approve the Settlement, a request for attorneys’ fees and costs up to $6,750,000 to be paid by Target, and service payments of up to $500 each for the Settlement Class Representatives (up to $1,000 each for the three Class Representatives who were deposed). But yes... I think they were negligent. I work for a large corporation. Security is SERIOUS. It is a constant battle and thought in all of our minds. Do I think they were negligent? No. Do I think they should have let us know right away. Yes. As for lawsuits? This bugs the CRAP out of me. If someone stole your identity and you went through a lot of crap because of that, then yes, file a lawsuit, but the rest of us? No way. Who is going to pay in the end? The consumer.

Ugh. I had my data breached through both of my last two employers. Someone filed for unemployment benefits in my name. Fortunately, while they had used an address that was one digit off from my actual address, the notice came to my house, and I was able to cancel the claim immediately. No other problems so far, but I was really ticked off.
Just FYI, the filing happened about two years from the last breach that I had notice of (I can't say for sure there have been no other breaches), so just because you had a breach and haven't had a problem so far, it doesn't mean you are in the clear forever.

They gave everyone access to free credit surveillance. It seems like that should be enough. I was satisfied with that as a remedy.

In my experience class action lawsuits make a lot of money for attorneys and when it is settled, I end up with a coupon worth $14.97.

We used to LOVE RH ~ went in earlier this year and were shocked at how much it had changed. And not for the better.

I don't qualify either since I didn't have losses.
But I'm even more jaded about these types of lawsuits now. The music cd one really irritated me since they decided rather than giving people a few $$, then donated CDs to libraries and then it was in the news that the CD's they donated were stuff no one even wanted. Why bother? But I'm sure the attorneys in the case are all laughing about it in their new beach houses and latest model cars...

Yes, it was a hassle to replace my card, but it's not like it hasn't happened before that and since then either. I am so tired of the sue happy - take everything you can get mentality over everything all the time.
