I have two basic questions and have been attempting to read/Google but my eyes are just glazing over...
1. How do you know when it's time to register your logo for trademark protection? Friend has a business she's built, selling one product that she makes. It's a food and 99% of her sales are local. She has a name and logo. When should she sink the money into registering the trademark?
2. If some other entity uses the same name, will she be able to register her name and trademark it? Does it matter if the other entity has no connection to her entity? Like hers is a food item and a dog kennel uses the same name.

I think different areas make the same name ok. If she really wants to protect her name then she should do it. I have a TpT store but I haven't don't any of that yet.

my friend went through a situation like this. she and another company had the same name. they sold similar items (clothing). both were racing to see who could trademark first. admittedly, my friend didn't trademark the name when she first started doing business under that name. they each had to provide proof of when they started using the name for commerce and if any sales were generated from the use of that name. my friend tried to do it herself but it started getting complicated so she hired an attorney. I believe she secured the trademark for that name for that particular category of product.

I think if your friend is even considering registering her trademark, then she should. Its better to be 'too early' than too late and have some other business trying to steal your customers.

Its better to be 'too early' than too late and have some other business trying to steal your customers. yup. better to secure the TM than deal with the awkwardness or inconvenience of sending cease and desist letters to someone using the same name to sell similar or same stuff.
