Okay, I know we used to have some car seat law expertz on the board. I am hoping they are still around. Ds is almost 11. He is only 4'3". Due to medical and genetic syndromes, we hope he makes it to 5 feet. He has been at 4'3" for 1 year and 7 months. He has only gained some weight. Anyways, booster seat laws in Ca are 10 yrs and 4'9". Ds may never get to 4'9"! In the middle seat of the Sienna, his feet touch the floor, his head is at the head rest, and the belt sits across his shoulder not neck and sits right on his hip area. My question is, when do you just give up on the booster seat??? At 11 can he just sit in the middle without it? He has almost outgrown the width of the booster too. I cant find one any bigger... I want him safe but what do those of us with short stature kids do? Especially when he may never see 4'9"

I just Googled the law. According to both the CHP and the DMV websites, it's 8 years OR 4' 9". That means that a 7 year old who is 4' 10" or an 8 year old who is 4' 3" is not required to ride in a booster seat.
I hope that helps.

The AAA article I read said 10 and 4'9". But sometimes its hard to keep up on these laws as they change all the time. I will just.double check with chp or the city fire department. Thanks

My understanding is the 8y OR 4'9'. My DS is 9 and still in a high backed booster (his preference) but he rides in the regular seat when we carpool from school. It is less than 2 miles from our house.

from CHP www.chp.ca.gov/programs-services/programs/child-safety-seatsHow do I know if my child is ready to move from a booster seat to a seatbelt? California law allows for a child 8 years of age or older to use a seat belt. However, it is safer for your child to remain in a booster seat until they can complete the 5-Step Test: The 5-Step Test: 1. Does the child sit all the way back against the auto seat? 2. Do the child's knees bend comfortably at the edge of the auto seat? 3. Does the belt cross the shoulder between the neck and arm, resting on the collarbone? 4. Is the lap belt as low as possible, touching the thighs? 5. Can the child stay seated like this for the whole trip?

There is a Facebook group that is amazing for this. Many of the women are techs on there. You can post questions and they typically give graphics and references back.
It is called Car Seats For the Littles and you will have to request to join.
