For over 2 years, DH has worked for a very small start-up that does audio software stuff. They came out with one product and have been working on some cloud/app options. In the early summer, the CEO and President told him they wanted him to focus on IP, and gave him the goal of filing 10 patents by the end of the year. The reward was to be a good bonus (which was 50% of his salary). Cool. DH has worked REALLY hard since, and actually got 12 done before Thanksgiving.
Then today, FedEx dropped off a letter for him. In it was a check with the memo "Last Pay." They also sent him an email saying his position had been eliminated and would be giving him 2 weeks' severance. He was PISSED. He wound up calling them and they argued about the bonus. They said they'd thought it would be around 1/10th of what it should have been. Apparently they'll let him know tomorrow what they come up with as a final decision on it. Anything's better than nothing, and I'm grateful for that.
But the situation still completely sucks. The last few years our financial situation hasn't been that great and our savings is nill. We know we're going to have to pay a lot in taxes next year. And DH does something VERY specific and has a VP title (he doesn't care about titles, but it may scare off potential employers). As a recruiter myself, I know how hard it could be for him to find something else, let alone quickly.
So I'm scared. Really scared. Had to break it to DD16 this afternoon, and she's worried that we might have to move. I'm just worried that... Well, at this point I'm worried about just about everything.
Just had to vent...
ADDING... Thanks, everyone, for your kind words and advice. To give some more details to hopefully clear up some things, it wasn't just DH who was laid off. There were two others as well. We've talked about it, and he's confident his being laid off had nothing to do with them not wanting to pay the bonus. He said if he felt it was something nefarious, he wouldn't hesitate to contact an attorney. He really thinks it was a money issue. It's a really small (10-ish employee) company, funded by angel investors, and they haven't been doing all that well. I think DH is kicking himself now for not getting the new bonus details in writing, but there's not much we can do about that now. I'm glad they're going to give him SOMETHING, and just have my fingers crossed that his networking yields him something quickly.

So sorry. Does he have a written bonus agreement? It is possible that he could be successful with a wage claim if so. Harder if it was just verbal or if it requires him to be employed as of the last day of the year.

That sucks. The timing sucks, the way they handled it sucks, the fact that it happened at all sucks. I'm very sorry and I hope an even better door opens soon for your dh.

So sorry. Does he have a written bonus agreement? It is possible that he could be successful with a wage claim if so. Harder if it was just verbal or if it requires him to be employed as of the last day of the year. It was written as part of his employment contract, but it does stipulate that he'd have to be employed at the end of the fiscal year in order to get payment. So I'm glad that they're willing to give him SOMETHING even though he won't be there when the payouts typically happen. (Not that they've ever paid out before...)

That really sucks! He exceeds their requested goal and when they realize they are going to have to pay a big chunk of bonus to him, they dump him. I wonder if this is something that the company has a history of doing to others. So unfair when he did what they requested of him. I hope he is able to get a good chunk in the way of bonuses. Is there any way he could get an attorney to look into wrongful termination? They claim they are eliminating his position...can the company go on without someone in that position, or will they have to hire someone, thereby showing the elimination of said position was merely to get out of paying his bonus? I hope there is some recourse for you.

So sorry!! Sounds fishy and lame mailing him his check... that sounds really sketchy and cowardliness on their part.
We been down that road without at job at Christmas (not that any time of the year is rough). No savings, nada. We barely hung on. And thanks for my mom who did help out.. Prayers for you and your family!!

Wow. I'm glad he had it in writing and I'm thinking that there is a great chance they did this so they wouldn't have to pay him the agreed-upon bonus. I'd be getting an attorney to at least look into the possibility.

If the check says "Last Pay" and it's cashed, could that be interpreted as accepting the cheeck as a last payment (meaning the person cashing it is accepting the terms -- that there will be no more payments of any type)? Please find out before cashing/depositing.

I'm so sorry. I KNOW it sucks!!! I hope that you can hold it together and he lands a job soon.
My husband was laid off in April. Some as your husband, he has a higher title. He gets told that he is over qualified quite often. I don't know if it is the title or salary that is scaring possible employers.
Our best piece of advice came from here. It was to get his LinkedIn information up to date and looking strong!
