"Tell-All Book on Trump Can Move Forward Pending Hearing, Judge Rules A New York appellate judge ruled on Wednesday that the publisher Simon & Schuster could go ahead with its plans to release a tell-all book by Mary L. Trump, the niece of President Trump, reversing a lower court’s decision from this week that had temporarily halted publication. The decision by the judge, Alan D. Scheinkman, means that Simon & Schuster can move forward in publishing the book, “Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man,” which is scheduled to be released at the end of July. In court papers filed on Tuesday, Simon & Schuster claimed that tens of thousands of copies of the book had already been printed, adding that it is a best seller on Amazon.... In his decision, Justice Scheinkman ruled that Simon & Schuster was not a party to — and thus could not be bound by — the confidentiality agreement, which was signed by Ms. Trump, Donald Trump and the president’s two siblings, Robert S. Trump and Maryanne Trump Barry. “Unlike Ms. Trump,” Justice Scheinkman wrote, “S&S has not agreed to surrender or relinquish any of its First Amendment rights.”" As a non-con-law scholar, I can only rejoin "duh". They should send copies to media, tv hosts, and need papers, like they did with John Bolton’s book. Then it will be out everywhere and there will no use to block the sales, because all the damage will already be out.

It won't help sway his base, but it may help solidify those in the middle who are leaning toward Biden. That's who you need to be concerned about. The never-trumpers are just as solid as the trump sycophants, but that 20% (give or take) in the middle are who will ultimately determine the election. BTW, according to this article, Mary Trump has filed to void the NDA based on trump's misrepresentation of assets when she signed the agreement. Why is this important? If he sues her after publication as "punishment," he will have to defend those allegations, and discovery will most certainly include his tax returns. I wonder if he will call her bluff? If the book is published, any lawsuit and discovery will not happen before the election--the wheels of litigation turn slowly and he would have as much time as the contract statute of limitations allows for him to sue her. The courts are generally not to fond of "prior restraint" attempts to stop speech. Generally, unless there are public welfare/national security reasons for prior restraint, the correct answer is to allow the publication with a follow-up lawsuit for damages. In the case of a valid NDA, the publisher is not likely to move forward to disclose protected information because they will have to pay back the profits and even the original compensation given for signing the agreement. In this case, trump has an NDA with Mary Trump, not the actual book publisher, which is why the injunction applies to her and not to the book publisher. If she publishes and is found to have violated the NDA, she would have to pay back the original settlement amount (and maybe interest) or whatever liquidated damages are listed in the contract. If trump continues to fight publication on the basis that the publisher is her agent and bound by the NDA, they can ask the court to determine the validity of the NDA. No valid NDA = no contract to breach. That hearing can happen a LOT faster than contract litigation. If this is in NY state court, I seriously doubt the court would allow a prior restraint unless trump can overcome the allegations of cooking the books. Those reports are in the news, and local witnesses are available who have gone on record stating that this was his practice. Once a witness testifies, trump's only real recourse is to provide documentation showing those statements are false. In other words, cough up the tax returns/valuations or drop the prior restraint.
