Hi peas, you ladies are all so wise so I thought I'd check if any military peas might have any experience in this or can suggest a course of action for my friend. The update to her blog post is that the CID has once again re-flagged him and is planning to prosecute him but they can't afford an attorney. I'm left confused, what is he being prosecuted for, exactly? Do they have the equivalent of public defenders in the military?

He is still active duty or being brought back on duty? He has access to trial defense through JAG so I'm not sure the comment about an attorney.

I'm not sure what is happening here. My DH is a commander and the JAG is brought in immediately with any legal matters.
He doesn't know what he is charged with after all this time? And they dropped the case but are now re opening it? Without paging through her very personal blog, I have no idea how to advise you, or what questions to ask my DH.

Is he still Active Duty, or was he discharged? She mentions taking military leave for the retreat 2 years after he told her he was "fired." How was he taking military leave if he was at home all that time, not working?
While I'd love to help, all her blog did was confuse the heck out of me. If he is military, JAG will take care of it for him. If he isn't, then they need to hire a lawyer, like any other civilian. They were able to afford a vacation to Puerto Rico, minus the airfare, so they should have some money for a lawyer.

If the military member has ANY FRIENDS in the JAG corps, if they had not contacted them before, now is the time to do so. Not so much to represent the military member, BUT to recommend someone to be the Defense Attorney. Otherwise, it is the Area Defense Counsel. WHICH IS A RIGHT every military member has access to contact. Some times when there is a situation at a location where multiple military members in one unit are under investigation... you may have to work with a ADC from another base. Not ideal, but doable.
That DOJ is out of it, is a good thing, that CID is reopening -- there is a "fishing" trip going on. The military member, or someone that person either works with or for, or possibly someone working for them, did "something" and is trying to shift blame. There are many things, and all sorts of people have their "agendas."
Through my DH's work I have heard of some "political appointees" going after something the previous administration did, and in the process, "tar and feathering" the military service members (current AND retired) as well as side-tracking and wasting resources on "witch-hunts" I do hope this is not what your friend is involved in.
If it is not that, it could be one of the big issues: Any "Equal Opportunity" complaints, based upon gender, gender identity, sex, age, race, religion, marital status, etc... these are the "sexy" things that get someone in the media.
Less "sexy" or not so media worthy are the way of doing business stuff. It could be use or abuse of funds, it could be using an invalid or previously valid fund cite, to pulling money from a "pet project" or putting money into a "pet project." And the black hole of "Contracting Misconduct."
For those NOT in the military, or NOT active within the five sided facility, it is difficult to imagine going through hell-fire based on a rumor... but it does happen. It is not (usually) the upper levels and ranks that get caught and hung to dry, it's the lower ranks, most of those are people doing a task they were told to do and had no reason to question what they were doing.
myboysnme brings up some good stuff. I am going off the "the military member did not commit a criminal act" and is innocent of criminal action. There is the possibility that there was a criminal act committed.

DH advises that if he is active duty, he has a defender through the ADC. That after all this time, he must at least know what he is charged with. They must have questioned him.
I don't think you have the whole story.

Looking at the information, it looks like the husband is still an active duty Army officer who had a moderately high level position where he should have or could have known about contracts that were being awarded and how former Army officers were profiting from the contract awards.
Because the CID is again investigating, it sounds like other information has come up probably related to but different from the original information in which he was exonerated. The CID is an Army agency so if he has any charges against him he will be tried in a military court with military JAG officers defending him.
If he is retirement eligible he should get out. His career cannot recover from all of this. Possibly he is a mid ranking officer taking the hit for some higher level misappropriations.
I'm not sure that I am OK about the family of a Lieutenant Colonel getting free tickets to vacation in Puerto Rico (or Colorado) but that's not the issue OP asked about. Either way, either wife knows more than she is blogging, husband knows more than he is telling wife, or they are both in the dark and he is being railroaded, but it is more likely he knows exactly why he is being questioned.

the ladies haven given good info but her blog and story is full of holes or bullshit- 30 months at home??? witness protection??? not being told about charges or what thay are investigating?? bs... i agree he shouldn't be in the military any longer- there is no way you can have a career after 30 months at home- if true

Skimming other posts it seems like the family has it's share of rough times, sickness,etc. Hope they get some peace.

I'm not military but I've never heard of anyone being "fired" from the military. There are processes to follow in order to "discharge" someone from the military. Story makes no sense.

Being 'fired' when in the military means you are going to be moving on to another job, and it will probably be something crappy, like desk duty if you're a pilot or if you are in charge of something, you will be moving on to a job with no authority and definately nothing that will enhance your promotion potential. It often means a career kiss of death, so folks just wait out their enlistment or go ahead and retire, or if an officer, just resign their commission.
