This story has been getting heavy coverage locally as the San Diego police investigation has finally been turned over to the DA. Lots of questions as to how SDSU handled/mishandled the case need to be answered. The names of the football players were made public when the civil suit was filed Thursday. Matt Araiza, the rookie starting punter for the Bills, is one of the named SDSU players accused of gang raping a 17 year old girl at an off campus party last October. The Bills may not have known about the allegation before the July, but Matt knew he was under investigation and it looks like he didn't mention anything before being drafted. I don't understand why no charges were made before this. Right after the attack, she reported it to the police and completed a rape kit. The results have not been made public and nobody has been charged. What is going on?? How long does it take to get the results back from the exam??

I showed the article to dh (Bills fan) and he was disgusted and said his butt needs to be in jail.
He should be removed from any game play and if charged removed from ever playing again on any NFL team.

Filing a civil suit now makes me think they don’t have enough evidence to make the charges stick. It’s not unusual for rape investigations to be lengthy especially one of this nature. Many states’ crime labs are horrifically backed up. It wouldn’t be unusual for it to take a year to get any dna results back and then there is the legal wrangling over getting dna samples from suspects and the testing of those samples against the samples from the rape kit. There also might not be any dna present — it’s not unusual for there not to be any dna present after as rape is the rapists have any modicum of intelligence. They have also probably been trying to access cell phones both of the alleged rapists, the victim and potential witnesses. Again that can be a lengthy process. The DA just got the case is my understanding — they have to review the case, they’re may be additional investigation their office wants to do and then they have to present it to the grand jury. The involvement of the Unoversity and football team just make it even more complicated and difficult. The timeline this far is not out of the ordinary.

His lawyer is certainly floating that story, but what is the appropriate timing? There is a strong sense that many invested in protecting Matt's future dropped the ball on the case. Filing now could equally put the brakes on his career and diminish her chances of a bigger payout. Maybe because her goal isn't a big payout, her goal is justice. SDSU has only now started an investigation. The football team has lots to answer for in regards to co-operating with the investigation and protecting the team last year when it was doing well, Matt specifically. The ball started rolling on this long before he signed an NFL contract. We will also know long before the civil case is heard whether criminal charges will be made. The DA is just starting their review. The sad truth is I don't believe for a second that this was a one-off gang rape and wouldn't be surprised to see other girls come forward with stories about the football team. There is a culture of entitlement and being untouchable lurking behind this story.

I hope charges are filed and all men who raped her serve time in prison. I also hope that he is sued in civil court. In this case, if he did rape her, she should be awarded damages. What a disgusting human being to do something like that.
We need to have serious conversations with our children about this type of crime. How many people saw her being carried to the bedroom and said nothing? It must have been obvious how intoxicated she was. We should be teaching our children to say something. We should be teaching our children to respect each other. And because there are too many scumbags out there, we should be teaching our children not to accept drinks from people that you can't fully trust. I have heard stories like this too often. It sounds to me like someone probably slipped something in her drink. That poor girl had no chance. It breaks my heart for her.

I also hope that he is sued in civil court. It is civil lawsuit that was filed on Thursday. The DA has only just received the police investigation so will be reviewing that and making a decision on criminal charges sometime in the future. christine58, we saw bits of the Bills press conference and weren't surprised they cut him quickly.

I think he will get his guaranteed money which was $216,148. He had a deal with Giorgio Armani that hasn’t paid him any cash but outfitted him in what was estimated to be about $15,000 worth of clothing. He also collected around $7,500 from Panini on a rookie card deal. I wonder if Panini will try to get back the money since there isn’t going to be a rookie card now.

The sentence was an outrage and led to the successful recall of the judge, but Turner will always be a convicted sex offender and required to register as such where ever he lives. And FWIW, I like this victim's attorney. I like the way he pushed back at Araiza's attorney trying to present her as just in it for the money. One of the other defendants, Zavier Leonard, appears to have been dropped from the SDSU football team in the last few days. The lawyer for the third defendant, Pa'a Ewaliko (never listed on the roster this year), was on the news last night floating the "she was so intoxicated she can't really identify my client" defense. FWIW, hop2, I do think it may be because the criminal justice system is bogged down in the patriarchy that this victim and her family are fed up with waiting and filed the civil suit. IMHO, I think the timing has a lot to do with the college football season starting and a desire to put future rapists on notice that we are watching. She doesn't want to see anyone else go through what happened to her.
