Well, we took a chance this morning and went to the DMV with what we had, hoping for the best.
Four hours later, DS has his ID and the drug test is done. (*happy dance!*)
The DMV guy didn't even look at the documentation, just put it all in a scanner and went about issuing the ID. I think we got extremely lucky today. Still, that error on the BC needs to be permanently fixed, so many thanks to all for the helpful advice on that. I have a call in to the Governor's office and Volt, I will be asking about separate files.

Why is it so difficult to get an error on a birth certificate fixed?
When DS was born 17 years ago, a mistake was made on his BC - it states he is a FEMALE. We went right away to the Vital Statistics Office, submitted the forms to have it corrected. Paid the fees. Blah, blah.
Received the corrected BC, but didn't need it again until 2012 and could not find it. (We're still tearing the house apart trying to find it.) Sent off for a new copy, and the copy we received still says he's FEMALE. WTH?
Multiple attempts to get it corrected since then have not worked. Every copy they send us still says FEMALE. Calls just end in them telling us to resubmit the request. Ugh.
As his BC has this error, he's not been able to get an ID, which he needs in order to get a job (among other things). He got an unexpected job offer today, but can't complete the required drug test because he doesn't have an ID.
I'm at a complete loss as to what to do. DS has until 2 o'clock tomorrow to get an ID and drug test to get this job. I'm angry, frustrated and feel like a complete mom failure.

How frustrating for you, especially when your son could lose a job because of it. It's not you who failed - it's the system (or rather, those who operate the system).
Can you go in person to the department? Tell them what's been happening, take your son so they can see for themselves that he's a boy, and tell them you will not leave until this mistake has been rectified permanently. Also get another copy of the amended certificate to take with you. And don't pay any more money to have it altered - it's 'their' fault it has never been done and you shouldn't have to pay another cent to fix their mistake.

We have paid so much money to get this fixed. Hundreds. As for going in person, that's not an option anymore as far as I can tell. Requests for corrections have to be sent to the state capitol, which is a 10 hour drive. And I will do that, but it still won't get this issue fixed in time. L

Is there an attorney who can petition the court to have the certificate changed? I know that's completely extreme but I'm just thinking someone has to be able to do something.
How about contacting your newspaper or TV station to see if they can do a story about it and get it fixed.

The Clinic I work at will use a school id, if a person doesn't have another form of id. Would that work for him?

I know this *isn't* the case with your son, but what are your state's policies regarding transgender persons and what their ID must say? Just wondering if there is anything on the books that would help you get his ID even though his birth certificate is obviously incorrect.

L And you might be ready to "move up the chain" there at the DMV. The folks at the front desk may not be able to help you just because they may not have the discretion/authority to accept documents other than the precise ones on their list. But they must have a manager. And that manager must have a supervisor. Be polite of course and let each level try to help you, but if they can't... Don't hesitate to ask for the next level up. Best of luck. Must be beyond frustrating!!

There's no mistaking that my 17yo, 6'1" son with a 5 o'clock shadow by noon is anything but born male. At 17, there's no way he could have gone through the process of transgendering. Still, it's all about what's on paper when it comes to government offices. L

I had the same problem with my DD's BC - it said she was male. I wrote and had it changed right away, but do you think I can lay my hands on the new one? NO.
It never occurred to me to worry about ordering another new copy, but now I see I should do that before she comes of an age where that could matter!

I moved to California four years ago and immediately went to the DMV to get a new license. I still have a copy of all my paperwork so I know I checked all the right boxes, but I was pretty surprised to receive my license in the mail and discover I'm actually a man according to the State of California.
Three new licenses later, I've given up. Every time a new one arrives it's identical to the last and I'm still a dude. I just can't bring myself to go back to the DMV again. The looks I get when I'm carded sometimes are priceless though.
Totally not helpful and I hope you get this resolved, but I totally get what a pain this kind of thing can be to rectify.

Did you check to see if the state has a different file for amended birth certificates? My dd was born in Texas. For some reason the state apparently has two filing systems... one for birth certificates processed at the time of birth and a separate file for certificates that were filed late or amended. We found that out after they told her she wasn't born in Texas. She was but there was a mix up and her information wasn't processed until she was about 3 years old.
If your state has a dual system and they find the original first they may not go looking for the amended one. I'd call and ask.

call the Governor's office - tell whoever answers exactly what the problem is and that you need it resolved today.
I did that back in 2000 when DMV wouldn't issue me a state id because I didn't have a birth certificate from one of the 50 states (I was born overseas and have a US state dept issued certificate of birth - which is only issued to US citizens born abroad) - I was transferred to the head of DMV for the State and he took care of it...my local DMV about rolled out the red carpet for me when I went back

I feel your pain, My nephew's name was legally changed when he was 10 years old. He took the court papers to the DMV when he got his drivers license and they did issue the license with his updated name. Apparently, his mother (my sister) never finished the entire process to amend his birth certificate. He is now trying to get an internship, as he is a college senior, and all of the agencies require a birth certificate with his current name to complete a background check. I feel terrible for him, as all the good internships have been snapped up. We are on our third try, and I'm keeping my fingers crossed that the latest set of papers we submitted to the Capitol will work.

My aunt received tremendous help in obtaining social security benefits due my disabled cousin from the late Paul Wellstone.

Glad the dmv didn't bother to check the bc so closely this morning.
I'm guessing the guy saw the name, looked at ds and didn't bother to check k to see if the gender matches.
