School records are never sealed. They are covered by "FERPA" (Federal Education Rights and Privacy Act" Ferpa covers who has the right to see school records (public or private). How long different types of records are kept is a state law issue. Some keep all records forever. Other school only keep grades or report cards forever. Some types of disciplinary records may stay permanently so a suspension record may be permanent but being sent to the principal's office for an infraction may not be in your permanent record.
Law enforcement would have a right to request school records. Once the records are in the hands of the police FERPA no longer covers them if they are part of evidence. If a school staffer leaked them they should be in trouble.
eta: the sealed/expunge would apply to court records not school records.
I really didn't think that a school report would say that much--31 suspensions in middle school? I went to private school... we had bad kids, but even the ones who thought they were the most badass weren't even in the major leagues... nobody would ever be allowed to be that big of a headache. We were scared to spit.
Kids in a private school have more to be held over their heads. They can be kicked out to attend public schools. Kids in public shools cannot be kicked out of school. They have a right to a free and appropriate education.
