I read it too and does look like he is being brought up before some Board on charges. So it sounds pretty accurate. And the claim that he doesn't know because he didn't live there for some time is RIDICULOUS!
I am about tired of Male judges discriminating in the favor of males in rape/sexual assault cases. No, I don't think they should be considered guilty before trial, but this assumption that the female ask for it or could have done something about it PISSES ME OFF! Maybe because I never got my day in court... they never found my scumbag (stranger in my home)..... I guess I was asking for it because I had my windows open?!?
eta: I am not Canadian but have been a SA victim.....

I wonder what the process for becoming a judge is in Canada? Are they voted in like in the U.S? Would petitions to make him resign work? What I cannot get over is how he said he was from South Africa and not familiar with Canadian laws. Ummm. what? You are a judge in Canada.

Huh. I wonder why no rape victim ever thought of that? I mean, it's so very simple. Knees together, no rape. This is could totally revolutionize self-defense classes. No heel of the hand to the nose, no knee to the groin. Just keep your knees closed. In case anyone didn't detect the sarcasm dripping from my post, I just wanted to show how ridiculous - RIDICULOUS- the judge's comments were. He should be removed.

This is local to me and has been in the news for awhile now ... Judges are not voted into the position here in Canada so it has nothing to do with politics ... This man has obviously said some terrible things (he seems to have no filter) and his career, thankfully, will never be the same ... the case is still in the courts ... I'm a survivor of sexual abuse, which I have been open about to the Peas, and I find his statements to be despicable

It's disgusting: he is up before a review panel. He claims to know nothing of Canadian criminal law, as he is a SA immigrant, even during testimony at the review panel he referred to the victim as the accused. He needs removed as judge and disbarred.
Judges are appointed. Been much talk it was the "old boys club" from Calgary including our former prime minister that got him the appointment. Oil & gas connections were powerful. I don't know if that is only rumour, or rumour based on fact, or true, but is feasible.

It isn't an unheard of mentality in the US criminal justice system. I've been working for a sexual assault agency this summer and one area they have been pushing is the testing of more rape kits. A surprising number of rape kits were not sent on because the victim was not considered credible. Included in being "not credible" was LEO's belief that the victim didn't try hard enough to resist. The victim may not even be aware they kit was never sent for testing.
