I don't think I have ever seen anything like this before. Because Congress hasn't repealed and replaced the ACA yet this guy is suing to get political donations back. He is accusing the GOP of fraud and racketeering. But what amazes me about this guy and other conservatives like him is they know what the key part of the replacement plan is and they are ok kicking millions off their insurance. It's like they are so hot and bothered to repeal the ACA that they don't consider the ramifications tonother Americans or they do but don't care. NORFOLK A retired attorney in Virginia Beach is so incensed that Republicans couldn’t repeal the Affordable Care Act that he’s suing to get political donations back, accusing the GOP of fraud and racketeering. Bob Heghmann, 70, filed a lawsuit Thursday in U.S. District Court, saying the national and Virginia Republican parties and some GOP leaders raised millions of dollars in campaign funds while knowing they weren’t going to be able to overturn the law also known as Obamacare. The GOP “has been engaged in a pattern of Racketeering which involves massive fraud perpetrated on Republican voters and contributors as well as some Independents and Democrats,” the suit said. Racketeering, perhaps better known for use in prosecuting organized crime, involves a pattern of illegal behavior by a specific group. The lawsuit lists as defendants the Republican National Committee and Virginia’s two national GOP committee members, Morton Blackwell and Cynthia Dunbar, as well as the Republican Party of Virginia and state party Chairman John Whitbeck. In an email, Blackwell dismissed Heghmann’s complaint as a “frivolous, nuisance suit that should be thrown out of court by any judge.” In a separate email Dunbar sent to Blackwell that was forwarded to The Virginian-Pilot, Dunbar referred to it as “ridiculous.” But at the same time, both said they understood where Heghmann was coming from. Blackwell said the suit is a “sign of conservative anger that the Republican-controlled Congress has not yet repealed and replaced Obamacare.” He argued that “progressives” had taken over the Democratic Party and seemed to lament that “conservatives” had not yet taken over the Republican Party. “Too few conservatives are willing to invest their time, talent, and money and personally participate inside the Republican Party,” Blackwell said. “A Republican majority will mean a conservative majority if and when a sufficient number of conservatives figure out why the success of their principles depends on their personal involvement in local, state and national Republican Party committees and in party nomination contests.” A spokesman for the state party did not respond to a request for comment. Heghmann’s suit comes a week after the Senate failed by one vote to approve a bill to repeal the ACA. It argues that the national GOP raised more than $735 million and Virginia’s party more than $20 million from 2009 to 2016 in large part by promising to repeal the Affordable Care Act. Heghmann said he has standing to sue the GOP because has been a contributor. Federal Election Commission records show he gave a total of $875 to New Hampshire’s GOP, but no donations were noted for the national party or Virginia. He was a Granite State resident for more than a decade – and a Trump campaign volunteer there – before moving to the Beach last year. He wants the party to either return campaign contributions to donors or exert pressure on Republican legislators to repeal the law under threat of losing GOP financial support. He acknowledged that members of the House of Representatives and Senate cannot be sued for failing to abide by campaign promises but argued that political parties don’t have the same protections. “If the candidates don’t deliver, it’s incumbent on the RNC to go to the candidate and say, ‘You can’t do this,’ ” Heghmann said before filing the suit, referring to the Republican National Committee. Heghmann’s suit contends that Republicans knew the GOP wouldn’t be able to repeal the health care law after President Barack Obama’s re-election in November 2012 but continued to raise money on the promise it would. As evidence, he pointed to comments by then-House Speaker John Boehner just after Obama’s re-election. “It’s pretty clear that the president was re-elected. Obamacare is the law of the land,” the Ohio Republican said when asked if the GOP-controlled House would push again for a repeal of the 2010 health care law. “There certainly may be parts of it we believe need to be changed. Maybe we’ll do that. No decisions at this point.” Heghmann’s suit states: “In making this statement Speaker Boehner was sending a message to House Republicans and others that Repeal was not going to happen. He was trying to put the issue to rest. ... Nevertheless, the Republican Party continued to use the mails, wires and interstate commerce to solicit donations and votes to secure House and Senate majorities and ultimately the Presidency. “Now that the Republican Party has won the House, the Senate and the Presidency the effort it is making to Repeal and Replace Obamacare is itself a Fraud upon Republican Voters and Donors.” The “pattern of racketeering” extended to the party’s response to Trump’s candidacy, his suit states. The GOP units raised money to push the health care repeal or Trump’s promises but “never intended to implement the Trump Agenda or fulfill the promises of the Republican Platform.” Is it wrong that I find this amusing? Although he should be suing trump.

" Consumer groups are making a last ditch effort to stop the Trump administration from stripping nursing home residents and their families of the right to take facilities to court over alleged abuse, neglect or sexual assault.
The Centers for Medicare & Medicare Services (CMS) announced plans in June to do away with an Obama-era rule that prohibited nursing homes that accept Medicare or Medicaid funds from including language in their resident contracts requiring that disputes be settled by a third party rather than a court.
Public comments on the CMS proposal to do away with that rule are due Monday and groups are urging the agency to reconsider.
More than 75 consumer, health and advocacy groups have come together to form the Fair Arbitration Now (FAN) Coalition to stop CMS from reversing what they claim is a critical protection for the elderly.
Remington Gregg, counsel for civil justice and consumer rights at Public Citizen, said the rule change is not only unnecessary, but shameful.
Gregg said the provisions, known to lawyers as pre-dispute arbitration agreements, create an unequal balance of power between the nursing home and its elderly patients or the family members caring for them.
"When you are trying to get someone in a nursing home, often time it's stressful or an emotional time. Often times loved ones can't take care of themselves, so for a nursing home to say in order to get in you have to waive your right is shameful," he said.
"We're talking about everything you may have a problem with - abuse, neglect, sexual assault, a wide variety of things - they are now saying you are waiving your right to full justice."
CMS said it decided to reconsider the Obama rule after a federal district court judge in Mississippi issued an order in November temporarily blocking the rule from taking effect.
The American Health Care Association (AHCA) and a group of nursing homes had sued CMS and the Department of Health and Human Services in October, claiming that the rule violated the Federal Arbitration Act, and that the agencies had overstepped their statutory authority in issuing the law. The AHCA said Congress has repeatedly rejected legislation to invalidate arbitration agreements.
In June, the federal judge agreed to the parties' joint request to put the case on hold while CMS revises the rule.
Under its proposed revisions, CMS said nursing homes would be required to write the arbitration agreements in plain language and explain the agreement to the prospective resident or his or her representative. Residents would also be required to acknowledge they understand the agreement.
The U.S. Chamber of Commerce is also backing the rule change. The nation's leading business group fought back against the original rule, claiming that restricting arbitration would raise the cost of nursing home care and make it harder, and more costly, for residents to resolve disputes.
"For many individual disputes, litigation in court is simply impractical. Litigation in court is procedurally complex, which means that non-lawyers need legal representation to have any hope of successfully navigating the system," the chamber said in 2015 comments to the agency it provided The Hill.
"But many plaintiffs' claims are too small to justify paying a lawyer to handle the matter and, in any event, most people do not have the resources to do so."
AHCA did not comment, but provided a fact sheet outlining its position, which said arbitration is faster and cheaper than litigation. It also claimed there's no limit on the monetary award that residents can receive.
The Fair Arbitration Now Coalition, though, is making a full court press to save the rule.
AARP, which is part of the coalition, argued in comments it submitted to CMS on Thursday that the agency lacks the statutory authority to eliminate a protection that was properly written.
"To the extent that CMS may be relying on the authority to promulgate regulations 'to promote the effective and efficient use of public moneys' the regulations still need to be for the benefit of Medicare and Medicaid nursing facility residents and not to their detriment," wrote the nonprofit group for Americans 50 years and older.
In its proposal to revise the rule, CMS said "upon reconsideration," it believes "that arbitration agreements are, in fact, advantageous to both providers and beneficiaries because they allow for the expeditious resolution of claims without the costs and expense of litigation."
But AARP claims that statement contradicts evidence the agency cited in 2016 when it issued the rule.
Carolina Fortin-Garcia, a CMS spokesperson, said the agency will respond to public comments received when it issues the final rule.
Opponents of the rule change are also weighing legal action.
Gregg said it's never a good idea to threaten litigation, but that Public Citizen will explore all of its options if CMS ultimately decides to allow arbitration agreements in nursing home contracts.
"Any agency action must meet a high bar for ensuring the action taken isn't arbitrary and capricious," he said.
"Simply making the argument that we are a new administration and want to make sure corporations don't have regulations that are forcing them to be accountable is not a good enough reason to change a rule that underwent extensive review."

In this morning's tweet storm tiny hands blasted Senator Blumenthal. It seems there are some vets that did not take kindly to that. Raw Story ran this piece. And the major outlets I’ve linked represent just a fraction of “mainstream media” coverage of the UN sanctions vote as well as the larger nuclear conflict with North Korea.
Nearly every major outlet treated it as an important story.
Only two conclusions are possible here: either Trump is deeply ignorant of the subject he is tweeting about, or he is a liar. Either way, he ought to show some respect for the truth. Trump could easily complain about media bias without misleading his base. Many thousands of news articles are published every day. He could always find an example somewhere that lends itself to a legitimate critique. If the president flagged aptly chosen content like that he might even spark positive change.
But Trump didn’t bother to find an example of flawed coverage somewhere. He just made up a complaint out of whole cloth, breezily misleading his followers about the world.
That insults their intelligence; he should stop."

Yes 24% No 73% So 10% of the voting population doesn't trust a word he says, but is still proud to have him as president? We've got some real winners out there. I think one of them is my mom's cousin, who was always crazy, but suddenly this past year (at age 89), she's Trump crazy. I could see her saying something like this.
