I have a house that hit the market last week. My A/C tune-up guy was there yesterday and all was well. My brother got there today to check on it. Someone has taken down the realtor sign, broken in, changed the locks, hung "no trespassing" signs in the window, and begun moving things in. We think that what happened is that a scammer changed the locks, pretended to be the owner, and rented it to an unsuspecting victim. My brother and the realtor are there now, waiting for the police. **Updated** The house is almost an hour from me so my brother was there and called me, and then the realtor came. When my brother told me he went inside and saw toys, I told him to get right back out and wait for the cops because he didn't know if anyone was still inside or whatever. The police finally came, and went in with him, and they walked the house. There were a few other random toys, but nothing else. So the toys could belong to the scammer's kids, or to an unsuspecting tenant. Looks like they were just absent mindedly left behind while parents were Changing locks? Taking measurements? Taking photos? Who knows. The realtor is the one who told me people were moving things in. She was just incorrect. Or assumed, or something. But no one had moved in yet, thank God. Police walked though but said there was nothing else they could do because nothing had been taken. They had taken the entire door knob and deadbolt off the front, including the realtor's lockbox. They'd changed the locks. They'd brought their dog because there was dog poop all over the back yard but said dog wasn't there. They'd pulled the realtor's sign out of the yard and thrown it on the side of the house. They'd disabled the garage door openers so they could presumably come in and out. So my brother was able to get in that way using our own key. A few windows had been unlocked. Mean while I went to Home Depot and bought all new locks and drove them out so he wouldn't have to leave the property unattended. We changed all the locks, locked all the windows again, re-engaged the garage door, posted a sign in the window that the house was NOT for rent and if anyone thought they had the right to live there, they didn't and to not attempt to get in, put the realtor sign back up, spoke with ALL the surrounding neighbors (one of whom saw a guy there this morning), and had the sheriff file a report. We also called the realtors for the other two houses for sale on the block and told them to keep an eye out on their homes too. We called the utility companies and put passwords on the accounts so they can't be switched. So now we're not quite sure if it has been "rented" or not or if the stuff belongs to the scammer. If it belongs to the scammer, he may come back because he hasn't rented it yet. I'll be interested to see how everything is tomorrow. He would have had to have acted REALLY fast because he was just there this morning, and my brother was there with the cops within a couple hours. So hopefully no one has been victimized yet. I've been combing Craigslist to see if there are any listings for it and nothing has come up yet, thankfully. ***Update Thursday*** Still quiet on the western front. They haven't come back and the neighbors are all watching like hawks. One called the realtor on me because I hadn't introduced myself to her yet and a different house called me when she saw my brother. The weekend poses too much risk for the scammer because so many people go see houses on weekends and all the neighbors are home. By now they have to know we know and I can't believe they would circle back around to us after the weekend. My gut tells me this started with the open house. My guess is they will hit another open house and pull the cord on their garage door and start this all over again. Coincidentally this was or first open house on any of our flips.

OMG That is awful! I hope it isn't too much of a nightmare to get whoever has moved in out.

Oh no, what a potential nightmare! I have heard of people moving into empty homes and it taking months and months to get them back out again. They claim squatters rights or something. I will be watching for your update.

That is crazy! I will be interested to hear the update on this. Did your brother and the realtor talk to the people who moved in? No. No one was "home." Thankfully, they had not moved in a lot of stuff yet. It looks like they brought over toys and stuff for the kids to play while they

Holy heck! I was just reading an article 2 days ago --- someone had the same thing happen. Someone broke into their house, changed the locks and put a For Rent notice on Craig's list - even had a lease and everything. Someone rented the house from who they thought were the owners of the house - only they were not!! Now they won't move out because they said they rented the house legitimately. (Apparently prepaid rent for 6 months and then prepaid another 6 months- they are in the 2nd half of the year living there). The courts says since they have a lease, they can't force them to move out, even though the owner was not the one they made the lease with. I feel for the family renting the house because how were they to know but still - it seems like if it is YOUR house, you could force people out if YOU didn't sign a lease with them. I hope you get whoever is in your house out of there....and it doesn't turn into a big mess. Wow!! I just can't believe people would actually do stuff like that. Save

If there is a "renter" moving in, I feel bad for them as well! That's crazy! ^^^ I feel sorry for the 'renters' too! But I wonder how far they would have gotten with it-- I mean, are all the utilities on while it's for sale? (we bought a foreclosure a few years ago and some of the utilities were shut off) Did the scammer figure he could just coast for a while until the utility companies shut off the service, screwing the renters in the process, or what? eta: and I think I saw an episode of Live PD that talked about 'establishing residency' as something like 2 weeks (perhaps it varies by state) and after that amount of time, whatever it is, you would have to go through the formal eviction process in the courts. But hopefully you caught this in time so that you won't have to go through all of that. I mean, it's pretty crazy, actually, that someone would move in, change the locks, AND rent the place in the space of a day!! This experience proves the adage "if it sounds too good to be true, it probably IS too good to be true."

I hope the laws are in your favor for getting them out immediately. Since you caught it immediately, hopefully there isn't any damage (other than the locks). We have friends that this happened to in The Netherlands. It was an expensive legal ordeal that drug out for over a year, then the cost to repair massive damage was even more.
Is it possible to cut off the utilities and force them out that way?

There have been issues with "squatters" in my area. They move into vacant homes and it takes forever to get them out. Hopefully, this situation is different since nobody has lived there yet.

Holy cow! Call a locksmith ASAP to come NOW and change locks back. Every minute and day is important, knock the door down if you have to. Today.
I am inclined to think this is not a renter under false pretenses because of the No Tresspassing sign.

Good luck - it's also possible that the previous owner is trying to retake possession - it happens with foreclosures. Depending on your state it can be an utter PITA to "evict" and yes that's what you actually have to do a squatter. It's why we do not own any rental property in California. It can literally take months to evict someone without a signed lease who has never paid you a dime of rent. And whatever you do make very, very careful that you know the laws in your state before doing anything like turning off utilities or changing the locks - that can actually make it HARDER to evict them and you can be subject to fines.
Keep using the word TRESPASSER with the sheriff/police. Make it abundantly clear that these people BROKE into your home and are TRESPASSING.
