That seems like total BS. With the proof in dates, the new renters should be offered the more expensive apartment an told that the original was unavailable for another month. They leased an apartment they didn't have, your daughter shouldn't have to pay for that literally and by moving all her stuff.

My opinion is that your daughter has written confirmation that her lease was extended. She gave notice and requested an additional month, which was granted on the 22nd. The apartment was not available to lease on the 23rd.

I’m curious what would happen if she stayed that month? I can’t imagine they legally could do anything since she has the paperwork stating her lease was extended.
Sounds like the building supervisor screwed up and is hoping to screw her, vs lose new tenants long term, or by taking a hit offering them a lease in the more expensive one for the rate they signed in. (If they let the new tenants know they didn’t have it availabile now I wonder legally if the building could be in trouble since I assume they too have a contract).

please let us know how she does, sounds like the leasing person made the mistake and trying to get out of it but with that email your daughter has goes a long way for her to prove her case...

Need a little more detail. When are they saying the new tenant gets her place? When do they want her out?
Are they saying it is leased out after January 6? If that is the case I think she is out of luck. She submitted her notice to vacate October 6, they were nice enough to extend her a month to January 6. If they are renting to someone after January 6, basically they are refusing to extend her another month.
If they are telling her it is leased out and want her out before January 6 then that is wrong and she should fight it.

When was she planning on moving out? You said she extended the lease because she didn't know at the time if her internship would turn into a permanent job or not, but it has - so is she able to move out by her original lease expiration date?
If she was planning on staying until January 6 she has proof in writing that her lease was extended. The leasing office screwed up - it's their problem.
ETA - OH, wait... the apartment is where she has been living for her internship! I understand now. She wants to continue living there and NOT move. It really was miscommunication on all parts. I would sit down with the leasing option and see what I could work out or start looking for another apartment.
