I admire the fact that you want to stand by the company jstblondie. I too love to support the small businesses whenever I can. However, I have a problem with business owners being extremely rude and irrational with their customers. I've boycotted Studio Calico for years for that very reason. I have no respect for women who step on other women on their way to the top. And for that reason I will never buy a Misti even if it gets a patent and they are the only maker of this tool. Tonic, on the other hand, has given me exceptional customer service over the past decade and has never once questioned my honesty about their product being imperfect. And for that reason I continue to wish Tim Holtz's new tool will be a hit once it hits the market.

I don't see how a freakin' press could get patented to the point of kicking all the stamp platforms out of the market. That doesn't make sense. It's a simple press but for modern-day stamps. I don't see how TH's design could be considered too similar either. It looks different design-wise and it has the switching plate with dedicated sides (acrylic and rubber stamps). I'm not a patent specialist but I don't see how they could possibly threaten Tonic Studios with a lawsuit with a leg to stand on. Otherwise, I'm going to need somebody to explain the history of portable printing presses to these pattern folks...

My husband has a small software company. Another company came out with the same product as his company. Sure they could have sued etc. but that cost a lot of money. They view it as competition. They keep their customers on fair pricing their product and customer service. We were at a trade show and the competition even stole one of their main products during set up time ( we had a secondd one)

That's the thing. She may have been the first person to put this particular product on the market, but it's not an original idea.

Maybe you've had no problems but many have. Not just people here but I've read about issues on lots of other boards and groups. I had to jump through hoops to get my cracked misti replaced and she was rude about it. In general it's the principle of ripping off a persons idea. Those bigger companies that do that are bullies. They know they can get away with that. It's just wrong IMHO That's what bugs me. This is true. The big companies know they can get away with it because they have deeper pockets and bigger lawyers. However, ol' Sweet Petunia must have thought she could get away with her bullying and harassing of "small" crafters online because she had a "patent pending. Goose meet Gander. I don't feel bad for her at all.

I looked at the misti webpage. If the patent was approved i would think she would have updated. I still says patent pending.

I belong to the FB group that was originally a MISTI group. The group had to change their name after the inventor of the MISTI made threats against the group for using MISTI in the name. There was a lot of discussion this morning similar to this thread. I am sure some of you are probably part of that group. Interestingly, the post about the recall was removed later in the day.

Back then the URL for fb groups had the name of the group in it. So even after the name was changed it still said MISTI in the address bar. The owner threatened legal action again so they had to completely close down the group and start a new one. The reason some threads about the recall were removed is because it was posted about a dozen times.

For what I paid for my Misti I can assure you that I have never purposely tried to break it! In fact, for what it cost I expected it to last for my entire scrapping lifetime! I'm not a fan of the creator, and I'm not really interested in spending any time "bashing" her, but when it comes to good customer service, she lacks and all I'm interested in is having someone else not waste their money on a sub-par product. Did she come up with a great idea? YES. Did she put out a high quality product? NO. I applaud and support any other company that offers a high quality product backed by strong customer service!

You know, the more I think about Tim Holtz's Tonic one, the more I think it won't get caught up in all of this. If there is anything to the rumor. Hampton Arts' tool is an exact replica whereas Tim's design is completely different and has some really great features. I'm looking forward to purchasing it!

Ugh, I hope it's not true! The Misti is so overpriced. That's why I never got one in the first place. I too would appreciate some links to these rumors. I really want the Tim Holtz one. I can't believe that Tonic would invest in product development if they didn't do extensive research on the first. I'm crossing my fingers that Tim's becomes available for purchase soon. Same here. No way would I buy the original MISTI, and not just because of the price. Reportedly, her customer service is poor, too. If this keeps the Tim Holtz version from being released, I will stick to my homemade version. It's not perfect, but it works. If the Tim Holtz version is released, I will be buying it.

I wonder if there are separate lawsuits pending against Stampoholic and Tonic studios, which are both not US based. Also, most likely the WRMK and HA lawsuits were filed prior to the announcement of the Tonic one.
If she did get a patent, she can still license her product to TH/Tonic - they will just need to pay her to use her idea.

One could be easily made of plywood, a hinge, and a sheet of poly. I would invite anybody to make their own. It's not rocket science. I made it with 5 pieces of plastic, a plastic piano hinge, and some glue. All for a cost of $18.67 incl. tax. I just bought a Hampton Art at HL for about $12, so except for the pride of making my own, I guess there is no point. At least now we all have an idea of the true worth of the tools. I still think the best positioner out there is the Letterpress with the floating hinge.

If you were maybe deconstructing hers and teaching people how to make a carbon copy of it, then that could be a problem...but taking the general idea and figuring out a way to make one for yourself is not something she could take legal action against you for. It sounds an awful lot like the Becky Higgins incident when it started taking off telling people that they couldn't use the term Project Life anywhere and how she went after blogs, etc and even then, because many people monetize blogs and youtube, she had more legal ground to stand on than this woman does. I'm glad that BH realized that it was wise to stop with that behavior because it wasn't a positive message about her brand...much like My Sweet Petunia has a reputation for not standing behind her product and treating customers in ways that are most certainly NOT sweet.
