ACOT has its preorder back up for a June estimate. I placed my order.
Was on the fence about getting any kind of stamp positioner, but this mess pushed me to the "I need the Tonic/Tim Holtz" mindset.

I really hope TH puts out a video soon showing the new version. I'm leery to purchase it now that it's been changed w/o seeing it shown. It would be really nice if they could pinpoint what the differences are. But I would settle for a demo video w/o an explanation of differences.

I'll be ordering a late May arrival (they're out of their late April stock) from the UK if all goes well (will place the order next week) so might also be getting the original version. This should mean My Sweet Petunia is relying on a US patent only then if Tonic Studios has and appears to continue to deliver stock to certain non-US retailers. I wonder how this will affect her brand. Will she trademark X amount of names and perhaps start up a sister company to drown the fish for future products? I think many of us are now unwilling to buy anything from her on principle. That's got to hurt. Like Skellinton, I'm curious to know which modification(s) were done to get My Sweet Petunia's legal team off their back.

My presumption is that it's minor and/or nothing at all and that they just changed the model number because the legal team went after the other model number specifically. That or they are planning to market it in a different manner...as in, 'not JUST for stamping' and providing other uses...and the modification is simple and minor enough to differentiate it from the MISTI enough to make her threat of legal action useless. Either way, I really hope they contest it. A punch is a punch is a punch and yet a million companies have it. Ink is ink is ink and the Hero Arts formula is what MOST other small businesses are going with when releasing their own inks now. She CAN NOT monopolize the entire market for stamp positioning...the stampamajig already exists for that, so she wasn't the first to the market to even argue it was a unique invention. She can patent HER method for accomplishing that, but I am fairly sure that other tools that do the same thing would not be considered a violation of the patent (which is why I think the only US based product that doesn't stand a chance is the Hampton Art tool) and I hope that the companies she's trying to threaten are planning on taking it to the finish line. Her ENTIRE tactic is hoping that the mere threat of legal action will deter any other companies. The thing is, if Kat is right, and other companies aren't rolling over then it means the more people she goes after, the more those companies can pool resources and work together to fight her and invalidate her patent and force her to start over with a more specific design patent. If you need to include formulas for drugs to patent and copyright them versus just a vague 'drug to relieve pain' then certainly a patent for a stamping tool would be the actual design of HER specific unit, not the result it achieves. Dang I wish Tonic had these selling 2+ months ago when the WRMK/AC and HA ones were out!! Then they could battle it out but I'd have the tool already!!

My thoughts EXACTLY. I'm so jealous of the people who got theirs before everyone and were able to post videos.

I'm not sure where our discussion was on that either. There are plenty bloggers that don't feel it's necessary to say they were given the product to demonstrate. I haven't seen that occur with any of the crafters I follow, unless I just don't know about it. Looks like consumers are complaining, and the FTC has fired a warning shot. I really like the fact that we have a true journalist reporting on news in our industry. I hope she keeps it up.

I know there has been some speculation about Jennifer McGuire and her stance on the MISTI. I just read this on her Instagram titled "A Candle loses nothing by lighting another candle."
I couldn't help but wonder if she is not only referring to Cathy Z, but also to MSP. Maybe??

People typically always root for the underdog, the start-up little guy company. If she is the little guy and people are actually rooting against her and waiting in line to throw their money at the big guy competitor, she needs to take a really long hard look in the mirror at what responsibility she has in this situation. How she has chosen to conduct herself with her constant threats of legal action is more than a turn-off. It has been appalling to witness. IMO she is the embodiment of what not to do in small business. My jaw dropped when I read her response here basically blaming the other person for her threatening legal action. Her response "well I asked politely" gives her some kind of moral high ground in her mind? Is it ever actually possible to "politely" threaten legal action?

From my understanding, she only trademarked the name to try and stop the Stampoholic venture from India. She applied to get it trademarked in February 2016. That's when the Stampoholic sort of exploded in the online community, right? Now that it has been granted, she can essentially stop any US retailer from selling it because of the name, making the MISTI the go-to product again in the country where scrapbooking is most popular. Knowing her sneaky ways with trademarks and patents (I'm guessing that if her husband is actually a lawyer as some have speculated, this is his specialty), she would have trademarked the Stampoholic name ahead of launching the product, not when reviews were dropping left and right online... She's just a bitter lemon, y'all. This one won't change by looking into a mirror. There won't be an epiphany moment about lighting metaphorical candles, etc.
