My husband and I made a trip to get some lumber for the stairs we're building on our front porch. Harley Davidson is next door so we stopped in. They happened to have a clearance sale on some gear so I was looking (yes, I know!) and found 2 pair of shoes I liked about 65% off of retail. I decided to get both pair. Went inside to pay and here's the conversation I had with the clerk:
Me: She told me 15% additional off if I took both pair. Her: yes 15% (talking over me)
Her: your total is:$xxx My husband: Is that right? It sounds high. Me: Yes, did you get the tags on the outside boxes (I saw 4 different prices on the shoes) Her: Annoyed, yes, it's this and this and this..... Me: OK, yep, that looks right.
She swipes my credit card.
Me: Wow, I'm surprised you guys don't take chip cards. Her: WELL, so-and-so downtown (restaurant) only takes cash (says it very condescending) Me: Well. That aside, you guys should look into a chip reader so you can be in compliance. Her: *wrinkles mouth to side* Yeah, I don't see us doing that. Me: (I know I'm giving her a wtf look). Well, every business is supposed to be in EMV compliance since October of 2015. Her: Yeah, we're not doing that. Me: You'll do it when you get a chargeback on a $30k bike after you swipe a card and their credit card company does a chargeback on you. It happened to me. I swiped a card instead using the chip and got a chargeback from the credit card company (BOA, not the customer) for $1200. Her: I don't see us doing that.
So is she just a bitch? Stupid? or both. I have a feeling she's just a clerk there. It annoyed me so much I thought about sending a msg to them on their fb page about it. A.) you have a snotty clerk. B.) you're so WAYYY not in compliance, I don't want you to lose a shitload of money, because it will eventually happen.

I don't understand the part about the charge back. I just swiped at an auto parts store today. I think whatever is up with the chip/CC is above her paygrade, so your explanation didn't really matter to her. She couldn't do anything about it. Sounds like she knows her management is not on it.

a LOT, probably 50% are not in compliance I read. I believe that October of this year they're going to start cracking down more. I've given lots of ppl that use square a heads up (that's what we use) after that chargeback happened to me.
I thought a place where all their transactions are pretty high, and you know they probably have ppl that can put a bike on a card, would care. It wasn't that she didn't know/care it was her steadfast "we're not doing it" like SHE has the choice/say. The owner was sitting there, I've known her since I was SIX YEARS OLD (my dad bought his first bike there in 1974). I felt like mentioning it to her. She's about 80 though, and drives a purple challenger.

I don't think it is bitchy or stupid. Just a clerk who doesn't have the power to change anything and doesn't care for a customer putting her in the middle for something like how credit cards are handled.
For what it is worth I was at several establishments in some small towns recently while my kids were at a tournament and not only did several have minimum purchase amounts for a credit card but one even charged $1.50 to use a credit card instead of cash. I think both of those things are against the contract with VISA or MC, but I didn't care enough to get into it with them since at the time I was dealing with a car full of cranky pre-teens.

I think she was just a clerk and you really should have laid off. What was she supposed to say “yes ma’am. We’ll take care of that right away” Her response says that it’s a lousy place to work and there are probably lots of things they need to do but they’re probably not going to do any of those things. Let it go.

I shop at the Navy Exchange at Walter Reed at least once a month, the last time being last week. They don’t use the chip readers, even though their card readers have them. You have to swipe your card. You would think that if it were a big deal that a military base store would use it.
It sounds like the only consequence is that the credit card company or bank can charge back fraudulent charges if the merchant chooses not to use a chip reader and read chip cards. It isn’t illegal.
If the merchant wants to make that choice about liability, it is their choice.
She didn’t have to be so snotty to you and it really wasn’t your business to keep pushing it with her either.

No "probably" about it. Since you say the owner was sitting there you should have addressed the owner about your concerns, not the clerk. Sales clerks have no say is how a business is run. You know that.

My first wondering was the age of the associate. A younger person might feel intimidated, unsure & a tish defensive by not knowing the answers or how to answer a corporate related question. Her response may have been a defensive mechanism by feeling nervous & not knowing how to respond.
Or, she just might be a b*tch and have a snide attitude. LOL

I had a clerk at a store (Toys R Us) tell me my pin number was too long once. It's 7 numbers. Their machine would only take 6. She kept telling me I must have typed it wrong because it was way too long and no one's pin was more than six numbers and I'd have to pay a different way. Well, my bank doesn't think so since it let me use a seven digit number... I just about walked out without my stuff before she sighed heavily and swiped my card as credit... She probably burned an extra calorie from all the extra work.
People are dumb...

From a business owner's point of view - chip readers suck. At least mine does. I have a Square Register and the chip reader that came with it only works about half the time. So I try to run the chip, it tells me its not connected. So I swipe. Many times that works, but sometimes the machine then tells me NO you have to use the chip. So I end up having to chip-swip-chip just to get it to work. I do appreciate the added security, but the technology isn't all up to handling it yet.

Yeah, she was a bit rude from the get go... bad day, annoyed when you questioned her about the price, jealous that you look better in those shoes than her... who knows what triggered it. However, that should have been your cue not to engage with her any further. Because you followed it up with comments about the card reader made it appear like you were trying to school her vs. do her a favor by warning her. If you really do want to help the business avoid a penalty, then don't post it on their FB page and tell the owner in person.

This ^^^. She could care less, just a clerk making minimum wage probably, waiting for 5:00pm to clock out. My husband tells me this: You tell the issue to the wrong person. Call the manager up and tell them. You tell clerks that could care less! Me: yah. But I will say, that the times I call for manager, they have the same care less attitude so I'm not sure why i bother.
