James Phillip Mault pleaded guilty during Friday's court proceedings, with the Observer reporting he had been charged with assaulting, resisting or impeding officers during the riot that sent lawmakers fleeing for their lives. "Court documents said Mault got a small canister of chemical spray from another member of the crowd and sprayed it at officers defending the tunnel. He got a second canister from the crowd and gave it to another rioter, records shows," the report states. "Earlier that afternoon, Mault was part of the crowd that overwhelmed a police line, 'forcing officers to retreat up a central staircase to the Lower West Terrace' at the Capitol, according to the U.S. Attorney’s Office." David Joseph Gietzen, 38, of Sanford, North Carolina, is charged with eight counts, including assaulting, resisting, or impeding officers with a dangerous weapon. The assaults took place between 2:13 and 2:31 p.m. on the day of the riot, according to a Department of Justice news release. The FBI criminal complaint against Gietzen stated that he was captured on police bodycams and open-source footage of the riot “wearing a green jacket, jeans, knee pads, and on occasion a white helmet and/or goggles. Gietzen is seen consistently moving up and down the police line along the security gate barriers… pushing with the crowd against the barriers and thrusting his fist against U.S. Capitol Police officers’ shields.” Videos obtained by the FBI also show Gietzen grabbing an officer by the throat or face mask, the arresting documents charge. “Gietzen hit the officer next to him with the pole, striking him in the shoulder between his protective gear. Capitol rioter whose parents raised money for him online pleads guiltyRay Hartmann May 23, 2022 Daniel Warmus, from Alden, NY, was the subject of a GiveSendGo campaign apparently created by his parents after the FBI arrested him in a raid at his home, according to the web page. He entered a guilty plea today, a year after that arrest. As Raw Story reported at the time, the FBI had learned about Warmus’ part in the riot from an anonymous tipster who had overheard him boasting about his exploits at a dentist’s office. “Warmus, from Alden NY, was heard by the tipster telling of how he smoked a marijuana cigarette inside the Capitol, the FBI criminal complaint states. The tipster said "that he/she overheard Warmus talking about his experience" which included having refused a police officer's instructions to leave the building." But the most distinctive part of Warmus’ story was the GiveSendGo page created by Patricia Warmus, who appears from its text to be his mother. Included in the narrative was this: “Daniel doesn't want too (sic) plea guilty since the Capital police were waving him in and the door was wide open.” The page offered his account of his arrest: “A helicopter flying over (Warmus’) home, 9 cop cars, 15 FBI officers. Agents wouldn't let Daniel's father near the home and wouldn't let him know where they took him. Mitchell Todd Gardner II, 34, of Seffner, Florida, signed a plea agreement providing for a sentencing range of 46 to 57 months and fines ranging $20,000 to $200,000. That’s among the higher totals for defendants who have plead guilty to crimes related to the January 6 riot, but anticipates Gardner asking that fines not be imposed. “Gardner was part of a mob just outside the Lower West Terrace Tunnel from approximately 3:45 p.m. until at least 4:05 p.m.,” according to a Department of Justice news release. “During that time, he shouted, among other things, “drag them out,” and “pull the cops out.” “Gardner used a (police pepper spray) device against officers within the tunnel area. The contents hit one officer directly in the face shield and splattered onto two additional officers.
