But this is a good time to appoint a new Justice, because if Rs take over the Senate, I expect McConnell to block any appointments that might come up.

Absolutely impeccable traditional credentials (including Harvard degrees and clerking for Breyer himself), was on the sentencing commission, and, dear to my heart, was an actual federal public defender. Has been both a federal district and appellate judge, appointed originally by Obama, so has been on the bench for a while. And 51, which is a mite older than frankly I like but within my acceptable range. She also was confirmed by this senate by more than the minimum votes.

But they haven't been opposed any of Biden's other nominees - haven't they confirmed like 50? I don't think they see confirming a judicial nominee the same way they see some of the legislation that will be unpopular for them back home. Hopefully won't be different for the Supreme Court. I agree with Darcy Collins - a Senate nominee, as long as it's a moderate, isn't going to be the kind of thing Manchin & Sinema will oppose. They had the risk of inflation, and the whole attitude that exists for a number of Americans re: entitlements to justify Build Back Better. And in terms of voting rights, with Republicans sounding like they'll support correcting the Electoral Count Act, and there being a bipartisan group making noises about a VRA, they had cover to vote as they did on the filibuster/Voting Rights. I'll be honest with you - there are a few provisions suggested in the voting rights bill that even I don't like. Specifically, there's no need to make election day a national holiday if you address the other issues (enough polling stations, both election day & for advanced polls). Even Canada doesn't have that - we have a provision that says you must be allowed 2 hours off, but that's it. And it can be leaving 2 hours early so you can get to the polls before they close at 8.

I don't the the candidate needs to be a moderate, I think he or she needs to be well qualified. A total left field candidate, such as one from academia without a law degree is a different story.

I also am an obvious fan of her age. Really, all the names I am seeing floated are brilliant women with perfect credentials and impressive experience. I think we have less ability to predict her confirmation path simply because this senate has not specifically confirmed her already (like some other potential nominees). I would be thrilled if she were nominated.

Both women are young, in terms of Supreme Court appointment. Jackson is 51 and Kruger is 45. And both have stellar legal credentials.
