Trump will likely take the Fifth in NY AG's case — and that could come back to bite him: analysts Sarah K. Burris February 17, 2022 "Assuming appeal is unsuccessful, Trump, Ivanka and Don Jr. must testify under oath," Honig explained. He anticipated that the Trumps would plead the Fifth Amendment against self-incrimination as Eric Trump did for six hours. Former federal prosecutor Joyce White Vance agreed that Trump will likely plead the Fifth. It presents a political problem for Trump, who has attacked those who've done so in the past. “The mob takes the Fifth,” Trump once declared. Vance further said Trump will likely claim his Fifth Amendment plea is "not because he’s guilty but because NY prosecutors are running a witch-hunt and they’ll use what he says against him no matter what." If that's the route Trump goes, fellow former federal prosecutor Renato Mariti explained, then Trump is between a rock and a hard place. Because this is a civil case, Trump pleading the Fifth means that it can be used in the Manhattan DA case. The jury in that case would be able to hear the context in which Trump pleaded the Fifth as part of the accusations against him. www.rawstory.com/trump-fifth-amendment-problem/I heard on the news today he used the Fifth Amendment hundreds of times during his “testimony” although I’m wondering if at some point he just started holding up 5 fingers or saying “ditto”?

I'm sure they're already being coached on what to "say", or rather how to keep their mouths shut. Won't they just plead the 5th on any questions? If not, I'm sure they will both feign memory loss.

Top shelf lawyers know not to make frivolous arguments to the court. top shelf lawyers stay top shelf by not having looney bin clients like him who will torpedo their credibility and reputation in the community Top shelf lawyers also generally like getting paid, and Trump is notorious for stiffing people for what he owes.

Ah ha! 'Unconstitutional attack on our Country!' Trump rages against NY AG in angry new statementBrad Reed February 17, 2022 Former President Donald Trump issued a rage-filled statement on Thursday after a judge ruled that he and two of his children had to testify in New York Attorney General Leticia James's civil lawsuit against the Trump Organization. After starting off by attacking Hillary Clinton and baselessly accusing her of "breaking into my apartment," the twice-impeached former president took aim at James and her investigation. www.rawstory.com/letitia-james-trump-2656715603/

Also, are we placing bets on how many times he'll plead the 5th?

Will trump Sr really plead the 5th though? He loves to hear himself ramble, I wonder if the right attorney can get under his skin will trump end up running his mouth about something. It really wouldn’t be hard to do, you just have to find the right sore spot to get under.

omg, where does he get these attorneys? first Guliani. then Sydney Powell. with all the money he is raking in in non-campaign donations (that he has discretion over) you'd think he'd be able to hire some top shelf representation. It’s not the point. He gets people who will be paid, they’re not there to do a good job, they’re just there to stall. He purposely ties people up into litigation (then doesn’t pay his bills) to try to bankrupt them or settle because of the strain of legal fees.

Yeah, all they need to do is get him talking about the numbers at his inauguration or toilets you have to flush 10-15 times and he'll just keep running his mouth...

It really wouldn’t be hard to do, you just have to find the right sore spot to get under. He already has trouble keeping his mouth shut. Per. Joyce Vance.. Trump is that nightmare of a client that you don't want to have as a lawyer, because he cannot stop talking, and we saw that throughout the Trump presidency," she said. "We saw it when he often revealed in tweets or in statements information that was then used against him, that formed the basis for understanding misconduct that he was engaging in. And he didn't do it just once or twice. He did it almost on such a regular basis that you couldn't help a little bit but feel sorry for all the lawyers around him. Or at least I often found myself wondering how they tolerated it." "And so you can have the best possible strategy," Vance added. "I don't know what that is in a situation where you're uncovering copious amounts of evidence of potential fraud, but perhaps you would look into finding that there was liability with somebody other than Trump, or you would say that somebody else was responsible. But he keeps saying that he runs the business, that he keeps the numbers. And when he makes statements like that five-pager he put out (Tuesday), he takes responsibility squarely for himself. I think if he is deposed, he'll be unable to resist running his mouth, and ultimately he'll continue to be his own worst enemy in this scenario." www.rawstory.com/donald-trump-2656716156/

He may be stalling but there is no settling or bankruptcy because the government ran out of money. He's stalling because he hopes a political power shift will kill these investigations.

mollycoddle we know that but his hoards ignore the truth! Sure, nothing will move the hard core base, but there have been a few cracks in his hold lately. Maybe it won’t make a difference, maybe it will.🤷♀️

Honestly, the fact that he trots out the image of Hillary the boogie man has turned into a joke. Even Hillary seems to be amused. They have cried wolf a few too many times. I saw a video yesterday of Hillary talking about what's going on and she used the term actual malice. I'm hoping that she can engage in an actual lawsuit. Because this is getting just ridiculous.

The *only* good thing about it is that it has become increasingly obvious that they do this every time Trump is in trouble. It won’t affect his hardcore base, but I am hoping that it might peel away some of his support. 🤞🏻 But who knows?

"You can't * handle* the truth!" (glad I wasn't the only one thinking of this, lol) One of my favorite movies. Jack Nicholson stole every scene he was in.

He can plead the 5th all he wants. They are building a criminal case against him and I heard on CBS news this morning that if all he does is plead the 5th, it looks REALLY bad for him in the criminal case. I don't know how but that's what they said.

I don't know how but that's what they said. It can’t be used in the criminal case — the whole right against self-incrimination. But, it can be used in any civil suits and juries are allowed to infer incrimination from the refusal to answer.

So if being a Republican is a protected class, then being a Democrat is too, right?
