Former's lawyer tells NY Supreme Court Judge that former and kids are a "protected class" Attorney Alina Habba was scolded by a judge on Thursday after she claimed that her client, former President Donald Trump, is part of a "protected class" because of his Republican ideology.During a court hearing in New York, Trump attorneys tried to convince state Supreme Court Judge Arthur F. Engoron that members of the Trump family could not be subpoenaed in connection with allegations that their company illegally manipulated property valuations. Habba told Engoron that Attorney General Letitia James is conducting an improper investigation into Trump because she does not like him. "She has such disdain for this person because he was president, because he is Donald Trump and he could probably win again in '24," Habba said. []b"He has First Amendment rights. He's allowed to be a Republican."[/b] He's a protected class," Habba insisted. "Ah!" the judge reacted. "What protected class is he a member of?""His political speech," Habba replied. "If he was not sitting as a Republican and was not a former president who might run again, this would not be happening. So she is discriminating against him for that."The judge's clerk stopped Habbo to point out that term "protected class" is usually reserved for race, religion and sex discrimination. "The traditional protected classes are race, religion, etc.," Engoron agreed. "Donald Trump doesn't fit that model. He's not being discriminated against based on race, is he? Or religion, is he? He's not a protected class. If Ms. James has a thing against him, OK, that's not in my understanding unlawful discrimination. He's just a bad guy she should go after as the chief law enforcement officer of the state."www.rawstory.com/donald-trump-protected-class/

omg, where does he get these attorneys? first Guliani. then Sydney Powell. with all the money he is raking in in non-campaign donations (that he has discretion over) you'd think he'd be able to hire some top shelf representation.

Most top shelf lawyers would never risk their license by representing the orange moron like this. And if they would then they aren't really top shelf.

I think he is using the only attorneys who are willing to attempt to represent him. After seeing Guiliani get disbarred, I think most are thinking, "Do I really want to do this?" and finding that they do not want to risk their livelihood and reputation on the case.

They know it's frivolous. It's just another thing to reinforce to his followers that they are "victims" of the "woke mob."
White grievance is all they have, so they have to keep flying that flag.

Former, Jr and Ivanka must appear!! JFC! It's about f#($*#ing time!
I am sick to death of too many ignoring laws, subpoenas, etc AND THEN getting off w/o consequences when they're rich and the rest of the population getting thrown in jail for the stupidest of infractions.

Well looky there. Trump is shitting bricks about now. What's scary is how is he going to scheme to get out of this one? Start another insurrection?

So, drawing the argument to its “logical” conclusion: Trump’s children should be exempt from subpoena because they are in a protected class based on the fact that they are adult children of someone who was a sitting Republican President and could win again?
It’s like the stretches have stretches. Gumby comes to mind.

There seems to be a number of Republicans that think they are immune from prosecution because of their "protected" political beliefs.

They are and always will be CHILDREN and should not be ever held to the expectation of adult responsibilities.

if they are considered "protected" then we should keep them safe....behind bars where we can keep an eye on them. maybe we can house them in a national park and tag them with GPS.

If the attorney general is not guilty of the charge of “disdain” lobbed against her, I sure am.

Trump will likely take the Fifth in NY AG's case — and that could come back to bite him: analysts Sarah K. Burris February 17, 2022 "Assuming appeal is unsuccessful, Trump, Ivanka and Don Jr. must testify under oath," Honig explained. He anticipated that the Trumps would plead the Fifth Amendment against self-incrimination as Eric Trump did for six hours. Former federal prosecutor Joyce White Vance agreed that Trump will likely plead the Fifth. It presents a political problem for Trump, who has attacked those who've done so in the past. “The mob takes the Fifth,” Trump once declared. Vance further said Trump will likely claim his Fifth Amendment plea is "not because he’s guilty but because NY prosecutors are running a witch-hunt and they’ll use what he says against him no matter what." If that's the route Trump goes, fellow former federal prosecutor Renato Mariti explained, then Trump is between a rock and a hard place. Because this is a civil case, Trump pleading the Fifth means that it can be used in the Manhattan DA case. The jury in that case would be able to hear the context in which Trump pleaded the Fifth as part of the accusations against him. www.rawstory.com/trump-fifth-amendment-problem/
