Judge Engoron under investigation over 'very troubling' talk with lawyer about Trump case

The New York judge who ordered Donald Trump to pay hundreds of millions of dollars in a civil fraud case is now under investigation, according to a report.

Justice Arthur Engoron's decisions are under a microscope after a local attorney said he had a conversation with the jurist about issues related to the former president's recent legal matter.

"A high-profile New York real estate lawyer, whose law license was once suspended, said he approached the judge presiding over Donald Trump’s civil fraud case to offer unsolicited advice about a law at issue in the case." the report states.

"Attorney Adam Leitman Bailey made the claim during an interview with NBC New York, saying he spoke to Judge Arthur Engoron three weeks prior to the judge’s February decision to fine the former president $454 million for falsely inflating the value of his assets," the article continues.

NBC further reported that the "judge, through a court spokesman, denied impropriety and said he was 'wholly uninfluenced' by Mr. Bailey."

"New York’s judicial oversight body has now launched an investigation into the alleged interaction, according to sources familiar with the matter," according to the news report.

The lawyer purportedly raised similar arguments as Trump did.

"Bailey, who said he is no fan of Trump, was not involved in the civil case and is not connected to any of the four separate criminal cases against the former president. He said he knows the judge from having appeared before him as a litigant 'hundreds of times,'" the article from Wednesday says. "Bailey said he 'explained to him' that a fraud statute at issue in the case was not intended to be used to shut down a major company, especially in a case without clear victims. He said such a ruling would hurt New York's economy. Engoron had rejected a similar argument raised by the Trump team in court."

Retired Presiding New York Appellate Justice Alan Scheinkman said he "has questions about Bailey's account."

"Scheinkman, who now teaches legal ethics at Pace University Law School, said the interaction described by Bailey is 'very troubling,'" the article says. "'The fact that this lawyer made these statements — unprompted — during a recorded TV interview should raise serious concerns,' Scheinkman said."

The Judge also pointed out that Trumps team concentrated on denying anything happened between Trump and Daniels in their opening statement, instead of denying the election interference angle. This meant the prosecution had no option other than to prove without doubt the incident happened by using Stormy as they did. Apparently they are also annoyed that Prosecution have decided they don't need to use Karen McDougal and tried to get the judge to admit that was improper. He pointed out that witness lists on both sides are a moveable feast.it seems beyond understanding that so called competent experienced lawyers ( these aren't Habba) would allow themselves to look so incompetent.

It's such a pity that New York doesn't allow cameras in so that the American voters can watch what Trump and his attorneys are trying to pull off.
I'm currently watching the Karen Read trial and if that wasn't televised, I doubt the apparent complete incompetence of the Canton police would ever have been exposed without the trial being televised.

Then, of course, she must have called her "nasty." One of his favorites to use on women. Sigh, he's so tediously predictable. I'll be glad when his "show" closes down and is forgotten.

J.D. Vance points out that Cohen cannot recall his son's age.. but he forgets his great golden leader's error!


Vance, in a series of tweets on X, assailed Cohen's credibility as a witness.

Cohen can’t remember how old his son is or how old he was when he started to work for Trump but I’m sure he remembers extremely small details from years ago!" Vance wrote.

But his comment came just days after Trump, in an interview Thursday with Telemundo51, misstated son Barron Trump’s age as 17. Barron Trump turned 18 in March.

In that interview, Trump told reporter Marilys Llanos he’s “able to put [aside]” the ongoing trial and focus on “a lot of things at one time.”

“I’m very ambidextrous, so to speak,” Trump said last week.

For the past several days, Donald Trump's allies have made statements that, if Trump had made them, would have clearly violated the gag order placed on the former president by Judge Juan Merchan.

Trump is prevented from attacking the witnesses, the judge's family, and the jury. In the last several days, however, Republican officials visiting Trump have done it all.

As defense attorney Jeff Jacobovitz pointed out during an appearance on MSNBC, Judge Merchan could use these attacks by Trump allies as a basis to call a hearing to determine if Trump coordinated any of the attacks with him.

"I saw basically the U.S. Congress walking into the courtroom to be there for Donald Trump — not the whole U.S. Congress, obviously," Jacobovitz told MSNBC. "But we have the gag order that was just approved by the appellate court, and if Trump is feeding any of these congressmen or senators information to talk about, that violates the gag order."

He explained that Judge Juan Merchan would want to know the specifics "and may have a hearing on it, and it could violate other gag orders in other cases that are pending now. And, so, that's a serious thing, and the court of appeals decision is something that has to be taken seriously."

This is from Volume II - the Obstruction of Justice Volume. The treatment of Cohen was part of a larger pattern of obstructive behavior by Donald Trump. Eventually, Bill Bar would write a memo declining to charge Trump for Obstruction even if he weren't the president. 3/

That memo was Trump's ticket out of facing charges for obstructing the Mueller probe. Had Garland charged Trump with obstruction, a judge would dismiss the charges 100 times out of 100 based on that memo. 4/

But today, this particular obstructive behavior toward Cohen, which was first investigated by Mueller, could lead to a conviction. We'll know in less than a month. END/


I wondered why nothing was ever done with Mueller’s laundry list of potential Obstruction of Justice charges in his report.  Now we know.
