I clicked on the link and saw that Crew Higgins is listed under Affidavit of Service. Does anyone know what that means? Thanks! After checking your link it sounds like some kind of medical lawsuit. However I can’t figure out why Becky and Crew would be involved, so perhaps not. Her “real person” IG has her stewing about getting her stickers done by a deadline that is approaching. She sounds very stressed and alludes to stuff going on in her life. She’s asking God for a miracle. I don’t mean to make light of her faith in God, but I do think God expects us to use our brains and figure out what is do-able schedule-wise and consider the commitments we’ve already got. No idea what the reference to Crew means in the affidavit reference. Wife of attorney here. This is speculation but Becky may be mentioned depending on how their family finances are set up and how the medical practice is set up. This is why some people with “means” have separate marital trusts or other financial structures to keep some protection of family assets from business/medical lawsuits. If she is mentioned it may mean all of their joint finances are at risk.

I think it means that Crew is the one who received the papers when they got served. Idk though cuz that seems odd. Would Becky be named if the suit was going after assets under Becky’s name? I really have no idea lol. But I do wonder if that’s why they are selling. She is mentioned in the lower section as “Rebecca Higgins, his spouse” (took me a moment to connect Becky as Rebecca, doh!) along with his anesthesiology practice, a little ways above the part about Crew. I checked and the affidavit of service does refer to details of who received the documents from the process server. He’s not a little kid any more, is he? Probably was the only one home, opened the door and signed for the docs without knowing what any of it was all about. I don’t understand much but it looks like they want a jury trial? I think being named in a lawsuit would definitely be contributing to her stress and is very likely linked to the sale of the dream house.

I think most doctors have malpractice insurance so their personal assets aren't at risk. It seems odd if it was a work thing to name the spouse.

Her old house for sure, 100% was foreclosed on, when she was building her new intentional cultivated mansion that she is now selling.

What's interesting to me is that there's a Scott Fyffe who owns a construction business in Scottsdale, AZ. Construction is quickly turning into Becky's sleep paralysis demon... I'm not familiar with the way Americans sue for medical malpractice but would it be normal to sue two orthopedic surgeons and the anesthesiologist? Would it be normal in such case to also have Becky as a defendant? Would the spouse of the person who has been the victim of said malpractice sue along with them? Would the victim still be named as a plaintiff if the spouse filed in their name (let's say if the spouse had the power of attorney in this case)? Is there any way that Becky being a defendant here would mean that this may not be linked to medical malpractice but payment issues re: construction work? (just speculating wildly here) Anyway, pop. dat. corn. I think we all know why Becky was laying it on heavy on social media recently and it isn't pretty, especially if it led to their sudden decision to put the new McMansion on the market.

I am not a lawyer but work in the insurance field.
It is very common in the US for plaintiffs to sue all the medical professionals that have any involvement in the case. As the case develops some of the defendants may move to be excluded and the final verdict may only assign liability and damages to some of them based on their role. If the injured person is deceased, the estate may be the plaintiff. The family of the claimant may also have a claim for the losses they feel they sustained (such as loss of consortium or support). It is surprising to see the spouses named. However that may be because they co-own the assets that may have to be used to pay damages.

Thanks for sharing your knowledge, pepperwood. I'm surprised Becky is the only defendant's spouse cited and that this lawsuit seems to be what spurred the sale of what is likely their main personal asset. It seems they may have gotten themselves in a bit of a pickle. It will be interesting to see how things develop and figuring out why their family home may be part of the assets that are at risk with this suit (could it be that the scheme they came up with regarding the previous home's foreclosure is now coming back to bite them in the buttocks?).

While it could be true, I'm more of a wait and see girl. Whenever I think I KNOW something, I am almost always wrong! It's a gift. It is similar to my pick the fastest line in the grocery store gift.

In thinking about this a little more, if her husband set up an LLC for his practice, Becky's name might be on the LLC. I think I noticed one other spouse's name on the complaint. It does seem like this is early in the lawsuit process to have to sell off the home, although they might be strapped for cash to retain a lawyer for the malpractice suit. I would agree with Karin that it might be unrelated. It is more likely that the bank that was left holding the bag when they foreclosed on the older home went after them for the outstanding balance when the bank learned that they had the money for the dream house.

Could they sell off the house now and put the money away in another house/investment that allows them to clear it from the personal assets that could be seized to pay damages in the future depending on how the lawsuit goes or is it too late at this stage?
There's no way they're so cash-strapped they can't pay the lawyer's retainer, right?

However the sum of my knowledge of BH is just from reading bits and pieces of this thread. Also, he will have malpractice insurance in place just for situations like this. My understanding is that an anesthesiologist being sued is not an uncommon occurrence.

I'm glad to hear I'm not the only pea who did a bit of a deep dive. Fun fact, the plaintiff's lawyer is Mormon. I couldn't tell by the Higgins lawyer's website. Looks like it was made in the early 2000's. I also saw the Scott Fyffe construction too.

I wanted to hop back in here to show a contemporary home that's been thought out and built well to underline the importance of professional help to build a home, particularly when it comes to a higher budget and larger living space. Use of materials, flow, human behaviour theory, it all comes together beautifully when it is done with care and knowledge. I understand the contemporary aesthetic isn't everyone's cup of tea but Becky's (soon to be ex) home is really mindboggling to me, especially at that price tag. Makes no sense at all. Maybe someone else reading this discussion will enjoy the house below or at least take something away from the Prospect and Refuge theory that is oh-so important, particularly in larger residential builds.
