Does anyone know how long this could take to play out - years? Yes, some lawsuits take years. Who knows how long it could drag on. I think it may not really last that long, though. If they can provide both evidence and precedence for challenging her patent, it might be over quicker than we think. If her patent, or at part of it, does get revoked, I wonder if Tonic will go back to court and appeal the judgment they received. I hope both possibilities happen. I think a lot of people will be watching the news on this with interest. I know I am.

Multiple years, most likely, with lots of back and forth between both sides. I imagine Tonic didn't want to get into it because even if they thought they would win the case, they'd lose too much in the drawn out battle bleeding legal fees? I've no idea how exactly one goes about challenging a patent, presumably there would have to be evidence presented of common usage or pre-existing designs that make it no longer 'novel and unique'.

I've no idea how exactly one goes about challenging a patent, presumably there would have to be evidence presented of common usage or pre-existing designs that make it no longer 'novel and unique'. Well, it's pretty easy to find a blog posting showing a Lifestyle Crafts Letterpress platform being used as a hinged stamping platform from way before the MISTI was ever a thing. And there was a brand of stamps (See D's, I think?) that had been showing their customers how to use the dvd cases the stamps came in for stamping (just like a MISTI) way before the MISTI was ever a thing, as well. Perhaps it will turn into a situation like when Spellbinders tried suing Quickutz over their dies with the open centers - Spellbinders got a patent on them and then went after QuicKutz; QuicKutz had been making that type of dies before Spellbinders came out with them. In the court filings, QuicKutz stated that they didn't apply for a patent because the technology was already being used in some industry (not crafting) and Spellbinders lost the case and ended up having to pay court costs and they lost their patent.

Most likely this. Plus the Tonic/THSP is still being sold at Scrapbook com, Amazon and a few smaller shops. I thought I read that the parties agreed Tonic could sell their existing inventory.? They must've produced a LOT of them. Maybe they thought how many ever they produced would be enough to recoup their R&D and production costs and be done with it. (and not incur additional legal fees as mentioned)

Mm, winning the battle only to lose the war isn't generally a successful strategy. Smart businesses always look at the bottom line, like it or not, that's more important to their long term survival than justice.

Just for fun I checked Ali Express and they have a bunch of cheap stamp positioners. Does the Misty person know about this? ? Granted they probably aren’t making a ton of money off of these but I wouldn’t put it past her to file against each and every one of them if she could. But of course she would have problems since they aren’t US companies. Too bad MSP.

I know that pirated designs being sold by foreign companies is a problem for a lot of American companies, and they really can't do much (if anything) about it.

China doesn't really acknowledge international copyrights, as far as I'm aware. And it'd be extremely expensive to try and go after them officially. You can Cease and Desist (that's how most bootleg stuff gets removed from AliExpress) but they're under no obligation to do anything else, and the products just migrate to a different store.

If Stampin' Up follows through w/the counter-suit through a judgement, I vow to spend at least $250 w/them. If they win, I will probably spend a LOT more w/them.

I'm glad they are challenging one of her patents. I wish that Tonic had held out against them in their lawsuit. MSP seems like she has a bully mentality. Sometimes the bullying only stops when someone stands up against them. I have felt for a long time that her patent should not have been approved. My impression was that whoever did approve it, was just lazy. I agree with all of this I was bummed that Tonic caved so quickly and easily. I'm excited about SU's challenge and hope they win! I also agree that whoever approved the patent didn't do their research!! I also feel MSP is a bully and sadly so far it seems to be working in her favor. I heard from someone that went to Creativation (whatever it's called) and she said Iliana was giving out goodies left and right. And that was not common for her and her impression was because she won her suits. She was also supportive of Iliana

Brand spanking new pea here! (I remember the original 2 peas shop, from back when I was buying up exclusive Quickutz dies lol!) I want to say thank you to everyone who has documented the demented behavior of MSP. I just recently found out about layering stamps and was like, how on earth do you stamp accurately with those sets? So I did research and found out there are such things as stamp positioners, and started researching those. I ordered a TH stamp positioner from SSS a few days ago, thanks mostly to great youtube comparisons and all you wonderful peas. It didn't hurt that SSS was offering 17% off of everything, so my Big Timmy cost about half the price of the My Soup Nazi Petunia piece-o-crap. (NO STAMP POSITIONER FOR YOU!) Now to pare down the list of layering stamps I MUST have. So thanks very much, and if anybody has tips for a new layering stamper, hit me up or point me to the right posts lol. I have so many questions, mostly about which stamp companies are the best and which inks you use. ( I have already picked out about 50 Hero Arts, Sunny Studio, and Altenew sets. Whew, this is gonna cost me a pile!)

Welcome, jackofallcrafts!
You already mentioned Altenew, which is my favorite layered stamp company.

Hiya and thanks for the welcome!
I spent most of yesterday drooling over the Altenew site, especially the build-a-flower sets. I don't like the fact that you *have* to get the dies with the build-a-flower sets, because that doubles the cost, and honestly, these are very simple shapes that you can cut out with scissors almost as fast as you can build a sandwich for the Big Shot, so I don't anticipate buying many (if any) of the matching dies. Besides, my die collection is immense as it is. I gotta have that Altenew carnation set though. That is drop-dead gorgeous!

Welcome to the Peas!!! I think Alt&New are probably the premier company for layering stamps. Also check out GinaK. She reminds me of more old school card making, but in a good way. People rave about her paper and ink.

Thanks for the welcome, zingermack and lisacharlotte! And thanks for the tip about GinaK. I had seen mention of her inks in Creativation videos but hadn't gotten around to checking her site yet. I had a thought about cutting out stamped images. Do you suppose I could get a Pixscan mat for my Cameo 3 to do that? If so, that makes the dies doubly unnecessary. Ugh, now I have to research *that* question, too!

Sunny Studios makes some really good layering sets. Not a lot of selection yet but theirs look so real when stamped. I have a few altenew ones-not the ones that come with the dies but I did buy the dies for the ones I have. Jennifer McGuire has some good videos on layering stamp tips. Just substitute TH stamp platform for the Misti she pushes.

Ugh, now I have to research *that* question, too! I don't have a Cameo, I have the Silhouette Curio and a Pixscan mat. I prefer dies but I would go Pixscan mat, the nice thing is, you can control your white space width around the stamp or go no white space.
Everyone is different but what works best for me, but maybe not for everyone is to scan the image and save it to a Studio document. Copy several in the document so that you can cut several or a bunch out at the same time.
Then cut out one of the negative parts out and tape down on the stamp press so you can place the blank shape in the correct spot each time. You can use a little piece of double sided tape to hold the shape in place if you like. Get your stamp in place in the negative area and lower the lid so the stamp clings to it. I really like this method best and maybe it will work best for you.
No way will I own a "M", I have made several of my own with two 8x10 or other size acrylic sheets, metal hinges from WM and duct tape a small WRMK magnetic mat to the bottom sheet to keep it in place. LOVE them!

Great tips, Angieandsnoopy, thanks so much!
I already have 8 Sunny Studio sets on my wish list, galew. Their "Everything's Rosy" set looks so similar to the Altenew build-a-flower rose set, and costs half as much, and more importantly, is available for sale! Is Altenew one of those companies that brings out a new line every month and then never makes it again? I've looked all over the net for the build-a-flower rose set and it's sold out everywhere, so I have no hopes of getting that one. If Altenew does make designs only once, that moves them up the list of priorities, I think.

I rarely buy matching dies for my stamps - I don't do much with cut out images. Just my thing. And another vote for GinaK. The inks she had at Creativation were her new amalgam inks (I think), which can be used with both water-based and alcohol-based markers. I have the black and really like it. The other inks she has are dye inks, and I like those as well; I ~~think~~ that there's a document on her website of colors that work well together for layering stamps. Her cardstock is really great, and her customer service is just about the best there is.

Gina K are my current favorite dye inks. I have a lot of them in cubes but just started buying in full size for background or big stamps. I'll probably get more eventually and phase out my stampin up inks. I like SU colors but the gina K smooth out so nicely after they're dry.

Found this on www.scrapbookupdate.com Update website today: Legal. After settling their patent infringement lawsuit against Tonic Studios in July, My Sweet Petunia moved on to another target in October: Stampin’ Up. In a widely anticipated move, My Sweet Petunia filed suit against Stampin’ Up in October 2018 alleging the company was infringing its patents on the MISTI tool by selling its Stamparatus tool. Stampin’ Up! has filed counter-claims against My Sweet Petunia challenging, among other things, the validity of one of My Sweet Petunia’s patents.

This is what I would suggest, too, although with one reservation. I have the Cameo 2 and the PixScan mat. Once I got a decent photo, it worked well. The problem for me is the energy efficient lighting in my house did not give me a good enough photo fir the PixScan technology, and I tried with two different but excellent cameras. I usually had to take my stamped image outside on a sunny day, place it on the concrete driveway, and take the picture. That was the only way the PixScan worked for me. So I gave up and bought a Scan N Cut, which I love for cutting out stamped images. It has to have a solid outside line to cut right, but it works well for a lot of stamps. However, the "cut first, stamp second" technique that AngieandSnoopy suggested is one of my favorite techniques. You get a perfect alignment, unlike trying to line up a die with a stamped image and hoping you got it right. There is a way to get the perfect alignment with a die, but I just prefer what AngieandSnoopy suggested. I have a Tonic stamp platform. It works really well for cutting first, stamping second.

There are some good YouTube videos, one from Silhouette that shows you HOW to scan each end and it joins together. I'm at lunch and don't have time to check it out completely but I think the link below is where I learned to use the scanner with PixScan mat.

Taking that long + getting out a specialized tool just to cut one straight line would drive me bananas. If someone is truly hopeless at cutting banners to the right size, I'd suggest they get some thin rectangle dies, not a plastic ruler that's going to put their fingers in danger. That or practice. Once you get the hang of lightly pressing the blade inwards towards the *metal* ruler, straight is a breeze. Agreed! My steel ruler which has cork on one side so it doesn't slip and I cut with my craft knife and it works just fine. The ruler cost about a $1 from the supermarket. Some stores here in Australia have the Cut-Align on pre-order and it retails for $34 - plus postage - which would end up a bit over $40. That's ridiculously expensive! And I can just see that the plastic is going to get damaged over time & once that happens, it's a bin job. Nope, wouldn't buy it even if it cleaned my Craft Room after a cardmaking session!

And it wouldn't matter what new products MSP comes out with, her reputation is fried.
