Nick Sandmann, the high school student in the smirking nose to nose video with a Native American in Washington, DC is suing CNN for $275 million for defamation. linkIs anyone else feeling less sympathetic toward him?

I say good for him, I hope he wins. The news outlets that keep abandoning journalism in favor of picking up narratives and running stories on them based on video clipped from all context and no investigation, need to be held accountable.

I say good for him. News outlets need to be held accountable for what they print. Instead too many are trying to be the first with a big scoop and don't bother to really investigate a story before they print/air it.

I actually hope he wins. This kid was pilloried all over the news AND this forum. It would be good for all of us to stop and wait to get all the facts before we rush to judgment.
About the "smirk". I never thought it looked like a smirk, personally. To me, it looked like a young kid uncomfortable as heck, caught up in a mess far beyond his young years to handle and just trying to put the best face on he knew how to do.

Are we going to hold Fox to the same standards?

I'd be interested to know on what grounds they arrived at that amount of damages. Has he suffered lasting damage to his life and reputation? Nope, he's resumed his privileged life as if nothing happened.
So how did they arrive at that number?

Just these 2 comments shows that he has suffered damage to his reputation due to the way the story was portrayed in the media. Especially online media which seems to have very little regulation or standard of truth. I know that this kid is nothing in my life, will never interact with him, but if someone was to bring the situation up my first thoughts go to the original retelling of what happened before further videos and explanations come out. And yes I will forever think of his face and think of him as a snot and that's due to these stories. I suspect they are asking that much but will never be awarded it. Aim higher then you expect.

I think it is a dangerous precedent. Anytime someone feels like they were misrepresented they can sue for a shit ton of money. My opinion hasn't changed either. I think this lawsuit makes him look worse than he did before.

But do your thoughts or mine have a anything to do with his life? My comment about his life of privilege refers to the fact that he's a white boy from a rich family attending an expensive private school, marching in the nation's Capitol to take away rights of women - especially poor women - to bodily autonomy. Is any of that in dispute? Oh well - the burden of proof is on him and his expensive lawyers. I guess we'll have to wait and see.

Good for him and I hope he wins. He did nothing wrong and that was proven and many that condemned him have apologized to him after seeing the whole footage. It is sad that people can't be kind.

I'd be interested to know on what grounds they arrived at that amount of damages. Has he suffered lasting damage to his life and reputation? Nope, he's resumed his privileged life as if nothing happened. So how did they arrive at that number? I'm not sure how they arrived at the number they're asking for, but I'm also not sure that we know if he's suffered lasting damage to his life and/or reputation. He's still only a kid and hasn't applied to college nor for a full-time job. Are there admissions officers or potential employers out there who would remember him solely based on that initial clip? If so, I think he may be entitled to significant damages.

Who is going to remember his name a year from now if he doesn't keep it in the news himself with lawsuits?

College admissions and employers routinely do social media sweeps on every prospective student or employee. Do you really think he can fade into anonymity?

Since the retractions to the original story have also been widely circulated, I can't imagine a college admissions officer not taking that into account as well. And if they're inclined to judge him for smirking at the native American guy as his friends tomahawk-chopped nearby, or for participating in a march against women's rights - well, those aren't defamation. They're correctly shown/reported.

I have no idea what his career hopes are, but let's shoot for the moon and make him a physician. Lifetime earnings could be as much as $10 million in that case.

I think the death threats that he and his family faced might also calculate into definitive, actual damages.

You know what would have solved his problem. He could have simply said, "I'm sorry. I meant no disrespect. I can understand how the video could be misconstrued." End of story. He looks good. Suing makes him like a douche.

Regarding the smirk. If I heard that word once in basic training I heard it a million times. When confronted I tend to try and put a neutral half smile on my face. However, at 19 and incredibly tense in a confrontation I’m sure it looked like a smirk as I was repeatedly told. At 53 I have better skills than I did at 19. I understood that smirk when the story was unfolding.

I thought cyber-bullying was considered wrong.
The damage to this kid is evident even in the title of this post "Smirking kid vs. Native American in Washington DC sues CNN".
He became the face of the entire confrontation because he hurled curses at a Native American? Because he beat him to a bloody pulp? Because he went on social media and denigrated him and his people?
No. None of the above. He stood there, making eye contact and "smirked". And for that, he got death threats and was slandered and libeled by politicians, celebrities, news organizations...
He is 16 years old.
I hope he wins.

I know some really hard core Trump supporters.
Truth is really, really important to them. When it comes to CNN. So they really hope that Sandmann sticks it to the liberal news media and makes hundreds of millions of dollars because CNN LIED AND THE MEDIA LIES AND THE TRUTH IS IMPORTANT AND NICK SANDMANN IS A VICTIM BECAUSE HE IS A WHITE MALE.
And then, they turn on Fox and eat up whatever lies Trump is spewing at that moment and return to their regularly scheduled anger toward libs and they talk about The Terrible Oppression of White People in 2019.
But truth. Yeah. Truth.

The people that don't think the expression on his face was smirking, we're not influenced by the narrative put forth by the media, so they didn't read it as a smirk.

It’s sort of like when you see a mug shot and you judge the person because they have a smug/proud/smirky look on their face that says they aren’t sorry at all about what they did or that they were arrested for it. This kid *looks* like an asshole. I don’t need a narrative to read his smirk. It speaks for itself.

College admissions and employers routinely do social media sweeps on every prospective student or employee. Do you really think he can fade into anonymity? I agree. I don't think he will ever fade into anonymity as long as social media exists. I think all of the media could do a much better job of finding out the facts of a story before trying to be the first to tell the story they want to have happened, whether it is true or not.
