So here's what I've read. Tim Holtz's positioner is not affected at this time. It wasn't an actual lawsuit but a cease & desist order sent to companies. These two companies happened to heed the order but maybe others got the same letter.
Also, American Crafts is supposedly coming out with a stamp press of some sort.

I watched videos of the TH positioner and liked it. While it is similar to the Misti, I hope there is enough difference to allow it to be sold.

I noticed some of the online stores are saying the Hampton Arts one is going to be back in stock next week. Maybe, the cease & desist didn't hold up. I am no expert at all about law but doesn't a cease & desist mean essentially a business restraining order? You have to go to court or arbitration to settle? I am all for business owners trying to protect their "ideas". I am not for business owners who bully elderly people. That is why I will never buy a Misti. I know I heard the sweet stories how it has changed so many lives of people who couldn't stamp before. I think that is really great. I am so happy and excited for them. What I will never understand about the owner is why she feels so easily threatened? She honestly really hurt herself over this and now is cutting into her profits and marketing money for lawsuits. She had to know she couldn't be the only special diamond in the crafting bunch that other companies would come out with a knock-off. The creators of Scor-Pal didn't fall apart when the Martha Stewart score board came out. They just kept on marketing and creating new things. The one community I have noticed that always has the same things in different variations is stamping. Look at stamp releases every week it was like all the companies had the same themes in different styles. I will give her one teeny tiny violin. Watching YouTube videos I did notice the HA version looked like hers. I thought she finally wised up and gave us blue, lol. Yes, that would have upset me too the similarities. I would have even told HA couldn't you just changed one thing besides the color! I do hope all of this settles very quickly in a positive way for everyone involved. gmcwife1 I love your sig.

Isn't a cease and desist order just a letter from a lawyer saying "stop doing x or we will pursue further action"? Perhaps HA realized that they have more money available to spend on lawyers than the Misti owner, and they can outlast her. I know a gentleman who has a pretty cool tool he invented (not craft related!) and he checked into having it patented. He didn't go forward with the patent because of the time and expense of getting one, and he said that the patent isn't that great a protection. If it's a useful invention, and it sells, companies WILL manufacture knock-offs, and then it is the patent-holders responsibility to go after them to make them stop, which incurs legal fees. Even though there was a good chance he could get his legal fees back if he won the suit, he didn't have unlimited funds to fight with until a settlement was reached, and any company that was making the knock-offs more than likely had lawyers on staff just to make his life miserable.
Unless the Misti owner has some nice lawyer who isn't charging her for their work (not likely), a good deal of her profits have to be going towards legal fees.

Thank you I agree with everything you've said. I have also thought the same thing about Scor Pal, the MS and the SU score boards. I would have stood behind the misti creator had she not handled herself in such an unprofessional manner, She gave her customers a really hard time when it came to her cracked tools and did anything she could to not stand behind her product. The threatening everyone that even made a handmade tool for their personal stamping was enough to push me from supporting her for good. And I too love to support the little guy or local business. So I wanted to stand behind her and support her.

I never felt the need for a Misti and once I heard stories about the owner, it cemented that I would never buy one. Way back in time, there were homemade versions of the Misti people would make. I made do with a stamp positioner. I probably will buy the TH version but I buy a lot of his products.
FWIW, I think anyone who comes out with essentially one product and doesn't diversify best be prepared for what she is dealing with.

Well, I hope that tonic can fight her tooth and nail and make her regret that she ever took them on. Actually, I hope the outcome is somewhat the same as when Spellbinders filed on QuicKutz, and Spellbinders lost the suit in spectacular fashion. Thing is, I wanted a Misti when they first came out. I was ready to buy one - even though I felt that it was really overpriced - and then all the uproar happened with her being so nasty to people who made their own and not willing to warranty the product. If she had just been decent - I'm not even talking that she had to be exceptionally nice or pleasant, or a friend to everyone she met, just basic politeness and decency - it would have made all the difference in the world. Now, anything connected with her, I will not ever EVER consider.

I keep saying it but I don't get how she feel so threatened. She must feel really bad about herself. I can't believe she is so willing to go this far to alienate herself in the crafting community and the peers of other companies that she will need to or could work with. You all know they are starting to side eye her. Poor Tonic & Tim they have really started their PR Campaign for this. Why couldn't she just be classy and work out an amicable resolution for all of this? I mean this is Tonic, WRMK & Hampton Arts we are talking about. Three respected companies that don't step on toes and very supportive of all their peers and business associates in the industry. Somebody need to slap her with a lawsuit for a poor quality made product. Dig up all her message board posts & e-mails on her not fixing the problems of her product but going after people. I was watching a You Tuber the other day that made her own art supplies. She made her own stamping press. She had to take the video down. This girl was special needs. She had a small channel and I think like a dozen subbies. She was so sweet and endearing. I thought to myself there just could be no way that the Misti lady would be so low she would actually pick on a special needs girl. I keep reading these stories and I really think she could go that low.

Yeah, I really wish the stamp celebs would quit endorsing the misti. I think it makes them look bad to affiliate themselves with her unchristian like behavior.
